TERMS OF REFERENCE

On November 22, 2005, the Legislative Assembly agreed that a Special Committee on Sustainable Aquaculture be appointed to examine, inquire into and make recommendations with respect to Sustainable Aquaculture in British Columbia and in particular, without limiting the generality of the foregoing to consider:

  1. The economic and environmental impacts of the aquaculture industry in B.C.
  2. The economic impact of aquaculture on B.C.’s coastal and isolated communities.
  3. Sustainable options for aquaculture in B.C. that balance economic goals with environmental imperatives, focusing on the interaction between aquaculture, wild fish and the marine environment.
  4. B.C.’s regulatory regime as it compares to other jurisdictions.
  5. Solicit and consider written and oral submissions from any interested person or organization by any means the Committee considers appropriate;

The Special Committee so appointed shall have the powers of a Select Standing Committee and is also empowered:

  1. to appoint of their number, one or more subcommittees and to refer to such subcommittees any of the matters referred to the Committee;
  2. to sit during a period in which the House is adjourned and during any sitting of the House;
  3. to adjourn from place to place as may be convenient;
  4. to retain such personnel as required to assist the Committee;

and shall report to the House as soon as possible but no later than May 31, 2007 or following any adjournment, or at the next following Session, as the case may be; to deposit the original of its reports with the Clerk of the Legislative Assembly during a period of adjournment and upon resumption of the sittings of the House, the Chair shall present all reports to the Legislative Assembly.

COMMITTEE ACTIVITY

The Special Committee on Sustainable Aquaculture is an all-party committee of the Legislative Assembly of British Columbia. Parliamentary committees are appointed by the Legislative Assembly of British Columbia to undertake business on behalf of the Assembly. Committees are comprised of Members of the Legislative Assembly. Committees derive their powers from the terms of reference provided by the House and must report their findings back to the House.

It is customary for a Special Committee to be chaired and have a majority of members from the government. The Special Committee on Sustainable Aquaculture is unique, as outlined in the throne speech in the first session of the 38th Parliament:

“The government will invite the official opposition to chair the committee and to also hold the majority of the committee’s members. This will address an important issue of vital interest to B.C.’s island and coastal communities, who elected so many opposition members to represent their interests.”

FIRST SESSION

The Special Committee on Sustainable Aquaculture met on November 24, 2005, where the first item of business was the election of the Chair and Deputy Chair. The Committee reviewed the terms of reference, including the logistical and procedural details of its inquiry. Members of the agenda and procedure subcommittee were also elected.

From November 2005 to February 2006 of the first session of the 38th Parliament, the Special Committee on Sustainable Aquaculture held three meetings, including an orientation meeting on November 24, 2005, a briefing session with various levels of government on February 1, 2006, and a planning meeting on February 2, 2006, where the Committee reviewed and finalized its business plan.

In its business plan, the Committee agreed to hear briefings from witnesses, conduct public hearings throughout the province, issue a call for written submissions, issue a request for proposals for a study on the economic impacts and prospects of the salmon farming and wild salmon industries in British Columbia, and conduct information-gathering trips to various aquaculture-related sites.

SECOND SESSION

On February 20, 2006 the Special Committee on Sustainable Aquaculture was re-struck, continuing with the terms of reference outlined in the first session. From February 20, 2006 until December 14, 2006, the Committee held a total of 35 meetings, including 21 public hearings, 8 briefings by witnesses, 4 subcommittee meetings, and a science forum. The Committee also visited 15 aquaculture-related sites.

PUBLIC HEARINGS

The Special Committee on Sustainable Aquaculture held a number of public hearings in June, October, and November 2006 to consider oral submissions from interested persons or organizations.

Prior to the public hearings, the Committee issued press releases and advertisements in local and provincial papers. Samples of the Committee’s advertisements can be found in Appendix A.

Due to the overwhelming turnout at the public hearings, extra meetings were scheduled to accommodate those who were unable to be heard in Campbell River and Vancouver.

In total, the Committee heard from 275 individuals and organizations at 21 public meetings. A list of presenters can be found in Appendix D.

WRITTEN SUBMISSIONS

On March 25, 2006 the Special Committee on Sustainable Aquaculture issued a call for written submissions on the issues set out in the terms of reference. The July 31, 2006 date for accepting written submissions was extended by three months to October 31, 2006. The extension sought to accommodate numerous requests from individuals who were unable to submit a letter by the original deadline.

By October 31, 2006, the Clerk of Committee’s office received a total of 815 written submissions.

All submissions will be carefully considered when the Committee formulates its recommendations for its final report.

All individuals and organizations that submitted a written submission to the Special Committee on Sustainable Aquaculture are listed in Appendix E.


OBSERVATIONS

During the course of the public hearings, witnesses shared their views with the Committee on a number of options for sustainable aquaculture in British Columbia. The Committee was impressed by the quality of presentations as well as the interest and desire to provide well informed suggestions on how to address the various aspects of the terms of reference.

Some themes that have emerged through a preliminary review of the written and oral submissions include: the importance of aquaculture-related activities to the economy of coastal and isolated communities; the environmental impacts of salmon aquaculture (such as sea lice, fish waste, antifouling paint used on nets, open net pens and closed containment technology); First Nations consultation; and, issues associated with the shellfish aquaculture regulatory regime.

In total, the Committee has heard over 100 hours of testimony and received more than 3,000 pages of written submissions from the public.


BRIEFINGS

As a key component of the Committee’s mandate, senior government officials, academics, scientists, as well as industry and environmental representatives, have been invited to provide testimony on issues identified in the Committee’s terms of reference. These include:

  4. Summary results of the 2004 and 2005 Joint Annual Report on Finfish Inspections (August 3, 2006)
  5. Application process for aquaculture sites (November 15, 2006)
  6. Overview of Fisheries and Oceans Canada 2006 research program (November 30, 2006)
  7. Association briefings (December 1, 2006)
  8. Briefings on the Science forum (December 5, 2006)

The Committee will continue to call witnesses in the coming months. This testimony provides crucial and valued information which will be reflected in the committee members’ deliberations and final report recommendations.

SITE VISITS

In conjunction with the public hearings, members of the Special Committee on Sustainable Aquaculture took the opportunity to conduct site visits in areas where the aquaculture industry is prevalent. The Committee felt it was important to meet with people working in the industry who had a first-hand account of day-to-day operations. These visits not only included processing plants and fish farm sites, but also science labs, educational institutes and manufacturing facilities.

ECONOMIC STUDY

On May 8, 2006, the Special Committee on Sustainable Aquaculture issued a request for proposals for a survey and assessment of the economic impacts and prospects of the salmon farming and wild salmon industries in British Columbia. (see Appendix B)

The Committee determined that a recent independent study which aggregated information on the two industries would benefit not only the government, but add to a growing volume of research being produced on the subject.

After careful deliberation, the Committee retained the services of MMK Consulting/Golder Associates to conduct the survey and assessment commencing June 2006. 

The findings of the study will be submitted to the Special Committee on Sustainable Aquaculture in early 2007, and may be included as part of the Committee’s final report.


REGULATORY REGIME

Section four of the Committee’s terms of reference is to examine British Columbia’s regulatory regime as it compares to other jurisdictions.  Thus far, the Committee has received briefings by the Ministry of Agriculture and Lands, Ministry of Environment, and the federal department of Fisheries and Oceans Canada, on past and current regulations.  The question of how these compare with the regulations of other aquaculture-producing countries—such as Norway and Chile—will be explored further in the coming months.


FUTURE COMMITTEE WORK

This First Report has listed to date the work of the Committee as it moves forward and enters its deliberation phase.  Evidence submitted by the public, both through the public consultation and written submission processes, will be considered along with the information provided by senior government officials, scientists, academics, industry and environmental associations.

The conclusions, with full recommendations, will be submitted as a final report deposited to the House no later than May 31, 2007.
