BARBERS AND HAIRDRESSERS STATUTES AMENDMENT ACT, 1992

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

 
Barbers Act

1 Section 8 (1) of the Barbers Act, R.S.B.C. 1979, c. 25, is amended

(a) by repealing paragraph (a), and

(b) in paragraph (b) by striking out "good moral character;" and substituting "good character;".

2 Section 11 (4) is amended by striking out "infectious and contagious" and substituting "communicable".

3 Section 12 is repealed.

4 Section 13 is amended by repealing subsections (2) and (3) and substituting the following:

(2) If a member is in default on February 1 in the payment of annual fees, the secretary of The Barbers' Association of British Columbia must give the member one month's notice by registered mail, addressed to the member's last known address, that the member's name will be removed from the register.

(3) If a member who is given one month's notice under subsection

(2) does not pay all outstanding fees owing to the association within the one month notice period, the secretary must remove the name from the register and must not restore the name to the register until all outstanding fees as of the date of restoration are paid.

5 Section 14 is amended

(a) in subsection (1) by striking out "fee of $2, produced a medical certificate similar to that required by section 8" and substituting "fee of $2", and

(b) in subsection (3) by striking out "year, on production of a medical certificate similar to that required by section 8 and" and substituting "year".

6 Section 16 (2) is amended by striking out "$15" and substituting "$150" and by striking out "$50" and substituting "$250".

 
Hairdressers Act

7 Section 6 of the Hairdressers Act, R.S.B.C. 1979, c. 159, is amended

(a) by repealing subsection (1) (a),

(b) in subsection (1) (b) by striking out "good moral character;" and substituting "good character;",

(c) in subsection (1) (d) by striking out "a fee of $15." and substituting "a prescribed fee.",

(d) in subsection (2) by striking out "of $15" and by striking out "a further examination fee of $5." and substituting "a prescribed fee.", and

(e) by adding the following subsection:

(3) The Lieutenant Governor in Council may prescribe a fee under this section and the fee for a first examination may differ from the fee for a subsequent examination.

8 Section 7 is amended

(a) by repealing subsection (2) (b),

(b) in subsection (2) (c) by striking out "good moral character;" and substituting "good character;",

(c) in subsection (2) (d) by striking out "a fee of $15." and substituting "a prescribed fee.",

(d) in subsection (3) by striking out "of $15" and by striking out "a further examination fee of $5." and substituting "a prescribed fee.",

(e) by adding the following subsection:

(3.1) The Lieutenant Governor in Council may prescribe a fee under subsection (2) or (3) and the fee for a first examination may differ from the fee for a subsequent examination. ,

(f) by repealing subsection (7) and substituting the following:

(7) Except as provided in this Act, a certificate issued by the board remains in force until the termination of the calendar year in which it is issued, but may be renewed from year to year, on

(a) payment to the board of a fee, for operating and nonoperating hairdressers for each renewal, that may be fixed by the Lieutenant Governor in Council, and

(b) the board being satisfied that the applicant is of good character. , and

(g) in subsection (9) by striking out "moral and medical fitness" and substituting "good character".

9 Section 8 is amended

(a) in subsection (2) by striking out "fee of $1, produced a medical certificate similar to that required by section 6" and substituting "fee of $1", and

(b) in subsection (5) by striking out "one year, on production of a medical certificate similar to that required by section 6 and" and substituting "one year".

10 Section 9 is amended

(a) in subsection (1) (a) by striking out "good moral character" and substituting "good character",

(b) by adding "and" at the end of subsection (1) (a), by striking out "and" at the end of subsection (1) (b) and by repealing subsection (1) (c), and

(c) in subsection (3) by striking out "moral and physical fitness" and substituting "good character".

11 Section 10 (1) and (2) (e) is repealed.

12 Section 14 (3) (c) is repealed and the following substituted:

(c) the protection of the public from communicable disease.
