MUNICIPALITIES' PROTECTION ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of British Columbia, enacts as follows:

1 The Municipal Act, R.S.B.C. 1979, c. 290, is amended by repealing section 755.2 and substituting the following:

Limitation on Municipal Liability

755.2 (1) Subject to any additional applicable conditions specified in section 755.4, a municipality inspecting and approving plans, inspecting buildings, utilities, structures or other things requiring a permit for their construction or issuing permits, has no legal duty, on which a cause of action can be based, to ensure that the plans or the buildings, utilities, structures or other things so constructed comply with the bylaws of the municipality or any other enactments.

(2) Subject to any additional applicable conditions specified in section 755.4, a municipality is not liable for damages of any nature, including economic loss, sustained by any person as a result of neglect or failure of the municipality to discover or detect contraventions of the bylaws of the municipality or any other enactments or from neglect or failure, for any reason or in any manner, to enforce those bylaws or enactments.

Commencement

2 This Act comes into force by regulation of the Lieutenant Governor in Council.
