JOB PROTECTION AMENDMENT ACT, 1997

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

 
Job Protection Act

1 Section 20 of the Job Protection Act, S.B.C. 1991, c. 4, is repealed and the following substituted:

Sunset provision

20 (1) Sections 1 to 19 may be repealed on or after April 12, 1999 by regulation of the Lieutenant Governor in Council.

(2) The repeal authorized by subsection (1) does not affect an economic plan or agreement that has force and effect under section 9 immediately before the date of the repeal, and sections 1 to 19 are deemed to remain in force on and after that date to the extent necessary to give the economic plan and the agreement force and effect according to their tenor.

 
Consequential Amendments

 
Forest Act

2 Section 50.2 (12) of the Forest Act, S.B.C. 1979, c. 140, is repealed and the following substituted:

(12) Subsection (11) and this subsection are repealed on the date, if any, on which sections 1 to 19 of the Job Protection Act are repealed under section 20 of that Act by regulation of the Lieutenant Governor in Council.

 
Forest Act, R.S.B.C. 1996

3 Section 56 (12) of the Forest Act, R.S.B.C. 1996, c. 157, is repealed and the following substituted:

(12) Subsection (11) and this subsection are repealed on the date, if any, on which sections 1 to 19 of the Job Protection Act are repealed under section 20 of that Act by regulation of the Lieutenant Governor in Council.

4 Section 20 of the Job Protection Act, R.S.B.C. 1996, c. 240 is repealed and the following substituted:

Explanatory Notes

[Sections 3 and 4 of this Bill amends the Revised Statutes of British Columbia, 1996. The Revised Statutes of British Columbia, 1996 come into force on April 21, 1997.]

SECTION 1: [Job Protection Act, re-enacts section 20] removes the existing April 12, 1997 "sunset" date for sections 1 to 19 of the Job Protection Act and substitutes a provision giving discretion to the Lieutenant Governor in Council to repeal those provisions by regulation at any time on or after April 12, 1999.

SECTION 2: [Forest Act, repeals and replaces section 50.2 (12)] is consequential to the repeal and replacement of section 20 of the Job Protection Act.

SECTIONS 3 AND 4: [Forest Act, repeals and replaces section 56 (12), Job Protection Act, re-enacts section 20] are consequential to the re-enactment of the statutes of British Columbia in the form of the Revised Statutes of British Columbia, 1996, which come into force on April 21, 1997. Sections 3 and 4 make the same changes in the 1996 revision as sections 1 and 2 make in the pre-revision versions of the Job Protection Act and the Forest Act.
