HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions

1 In this Act:

"Agreement in Committee" means

(a) the Agreement in Committee signed on behalf of the government and the BCTF on April 17, 1998,

(b) the Memorandum of Agreement K-3 Primary Class Size signed on behalf of the government and the BCTF and appended to the Agreement in Committee,

(c) the article entitled "Salary Determination for Employees in Adult Education" signed on behalf of the government, the employers' association and the BCTF on May 7, 1998, and

(d) Article A.1 entitled "Term, Continuation and Renegotiation" signed on behalf of the government, the employers' association and the BCTF on May 4, 1998;

"BCTF" means the British Columbia Teachers' Federation;

"employers' association" means the British Columbia Public School Employers' Association;

"parties" means the BCTF and the employers' association.

Constitution of collective agreement

2 (1) Effective July 1, 1998, the Agreement in Committee is deemed to constitute a collective agreement between the parties.

(2) The Agreement in Committee may be varied by agreement between the parties.

(3) Despite subsection (2), a provision of the Agreement in Committee that creates obligations for the government must not be varied unless the minister approves the variation.

(4) The Labour Relations Code and the regulations under it apply in respect of the matters to which this section applies, but if there is a conflict or inconsistency between this section and the Labour Relations Code or any other enactment, this section applies.

Commencement

3 This Act is deemed to have come into force on July 1, 1998 and is retroactive to the extent necessary to give it effect on and after that date.
