CONSTITUTION (FIXED ELECTION DATES) AMENDMENT ACT, 2001

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 23 (2) and (3) of the Constitution Act, R.S.B.C. 1996, c. 66, is repealed and the following substituted:

(2) Subject to subsection (1), a general voting day must occur on May 17, 2005 and thereafter on the second Tuesday in May in the fourth year following the general voting day for the most recently held general election.

(3) In subsection (2), "general election" and "general voting day" have the same meanings as in section 1 of the Election Act.

Commencement

2 This Act comes into force by regulation of the Lieutenant Governor in Council.

 
Explanatory Note

SECTION 1: [Constitution Act, repeals and replaces section 23 (2) and (3)] schedules the next Provincial general election for May 17, 2005, and each Provincial general election thereafter on the second Tuesday in May in the fourth year following the most recently held Provincial general election.
