HEALTH AUTHORITIES AMENDMENT ACT, 2002

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 1 of the Health Authorities Act, R.S.B.C. 1996, c. 180, is amended

(a) by repealing the definitions of "community", "community health plan" and "council", and

(b) in the definition of "specified services" by striking out "region or community," and substituting "region,".

2 Section 3 is amended

(a) in subsection (2) by striking out "region or community." and substituting "region.", and

(b) in subsection (5) by striking out "board or council" in both places and substituting "board".

3 The heading to Part 2 is repealed and the following substituted:

Part 2 -- Regional Health Boards .

4 Section 5 (1) (e) is repealed.

5 Sections 6 and 7 are repealed.

6 Sections 7.1, 8 and 9 are amended by striking out "board or council" wherever it appears and substituting "board".

7 Section 10 is amended

(a) in subsection (1) by striking out "council and board" and substituting "board",

(b) in subsections (2) to (5) and (8) by striking out "board or council" wherever it appears and substituting "board",

(c) in subsection (3) by striking out "Minister of Finance and Corporate Relations" and substituting "minister charged with the administration of the Financial Administration Act", and

(d) in subsection (7) by striking out "board and council" and substituting "board".

8 Sections 11 and 14 are amended by striking out "board or council" wherever it appears and substituting "board".

9 Section 15 is amended

(a) in subsection (1) by striking out "a community health services society designated by the minister for purposes of this section, board or council" and substituting "a board",

(b) in subsection (3) by striking out "A community health services society designated by the minister for purposes of this section, board or council is exempt" and substituting "A board is exempt", and

(c) in subsection (3) by striking out everything after "the purposes of this Act" and substituting "between the board and a public body or a board".

10 Section 15.1 is amended

(a) by striking out "sections 15.2 to 15.5:" and substituting "sections 15.2 and 15.5:",

(b) in the definition of "designated area" by striking out "or 6 (1) (b)", and

(c) by repealing the definitions of "new council" and "old council".

11 Sections 15.3 and 15.4 are repealed.

12 Section 15.5 is amended

(a) in subsection (1) by striking out "15.2, 15.3 or 15.4," and substituting "15.2," and by striking out "board, the new council" in both places and substituting "board", and

(b) by striking out "Officer, Ministry of Health," wherever it appears and substituting "Officer of the minister's ministry".

13 Sections 16, 16.2, 17, 18 and 19 are amended by striking out "board or council" wherever it appears and substituting "board".

14 Section 19.1 is amended in the definition of "facilities subsector" by striking out "the Tilbury Regional Hospital Laundry Society (Tilbury Laundry),".

15 Section 21 is amended

(a) in subsection (2) (d) by striking out "and 6 (4)",

(b) in subsections (2) (j) to (m), (3) (c) and (d) and (4) by striking out "board or council" wherever it appears and substituting "board",

(c) in subsection (2) (n) by striking out ", or under section 7 for councils",

(d) by repealing subsection (2) (o) and substituting the following:

(o) the exemption of boards from the obligation under an enactment to pay a fee or tax. ,

(e) in subsection (3) (a) by striking out "boards and councils" and substituting "boards", and

(f) in subsection (4) by striking out "boards or councils" wherever it appears and substituting "boards".


Consequential Amendments


Criminal Records Review Act

16 Section 1 of the Criminal Records Review Act, R.S.B.C. 1996, c. 86, is amended in paragraph (d) of the definition of "employer" by striking out "or community health council".


Freedom of Information and Protection of Privacy Act

17 Schedule 1 of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165, is amended in the definition of "health care body" by adding "or" at the end of paragraph (f), by striking out "or" at the end of paragraph (g) and by repealing paragraph (h).


Ombudsman Act

18 Section 28 of the Schedule to the Ombudsman Act, R.S.B.C. 1996, c. 340, is amended by striking out "and Community Health Councils".


Property Transfer Tax Act

19 Section 14 (4) (a) of the Property Transfer Tax Act, R.S.B.C. 1996, c. 378, is amended by striking out "or council".

Commencement

20 This Act comes into force by regulation of the Lieutenant Governor in Council.

 
Explanatory Notes

SECTION 1: [Health Authorities Act, amends section 1] deletes references to community health councils and attendant references to "community" and to "community health plan". Organization under the Act now centres on regional health boards and references relate to councils are redundant.

SECTION 2: [Health Authorities Act, amends section 3 (2) and (5)] deletes references to "council" and "community".

SECTION 3: [Health Authorities Act, re-enacts heading to Part 2] deletes a reference to councils.

SECTION 4: [Health Authorities Act, repeals section 5 (1) (e)] repeals a redundant reference to the powers and duties of councils.

SECTION 5: [Health Authorities Act, repeals sections 6 and 7] repeals sections providing for the establishment of councils and setting out the purposes for which they were created.

SECTION 6: [Health Authorities Act, amends sections 7.1, 8 and 9] deletes references to "council".

SECTION 7: [Health Authorities Act, amends section 10] deletes references to "council" and updates a reference to the Minister of Finance.

SECTION 8: [Health Authorities Act, amends sections 11 and 14] deletes references to "council".

SECTION 9: [Health Authorities Act, amends section 15 (1) and (3)] deletes references to "community health services society". Organization under the Act now centres on regional health boards and references related to "community health services society" are redundant.

SECTION 10: [Health Authorities Act, amends section 15.1] makes consequential amendments in light of the deletion of reference to councils in the Act.

SECTION 11: [Health Authorities Act, repeals sections 15.3 and 15.4] repeals provisions that are no longer relevant in light of the deletion of reference to councils in the Act.

SECTION 12: [Health Authorities Act, amends section 15.5] makes consequential amendments in light of the deletion of reference to councils in the Act.

SECTION 13: [Health Authorities Act, amends sections 16, 16.2, 17, 18 and 19] deletes references to "council".

SECTION 14: [Health Authorities Act, amends section 19.1] deletes a reference to the Tilbury Regional Hospital Laundry Society in the definition of "facilities subsector".

SECTION 15: [Health Authorities Act, amends section 21] deletes references to councils and a reference in subsection (2) (d) to section 6 (4) of the Act, since that section is being repealed by this Bill.


Criminal Records Review Act

SECTION 16: [Criminal Records Review Act, amends section 1] deletes a reference to community health councils.


Freedom of Information and Protection of Privacy Act

SECTION 17: [Freedom of Information and Protection of Privacy Act, amends Schedule 1] deletes a reference to community health councils.


Ombudsman Act

SECTION 18: [Ombudsman Act, amends section 28 of the Schedule] deletes a reference to Community Health Councils.


Property Transfer Tax Act

SECTION 19: [Property Transfer Tax Act, amends section 14 (4) (a)] deletes a reference to councils.
