COMMUNITY CHARTER TRANSITIONAL PROVISIONS, CONSEQUENTIAL AMENDMENTS
AND OTHER AMENDMENTS ACT, 2003

Part 3 -- Other Amendments

535 Section 11 (3) of the Community Charter is amended by adding ", prohibit and impose requirements in relation to" after "power to regulate".

536 Section 16 (6) (a) is amended by striking out "regulate, prohibit or require;" and substituting "regulate, prohibit and impose requirements;".

537 Section 23 (1) (b) is amended by striking out "regulatory authority" and substituting "authority to regulate, prohibit and impose requirements".

538 Section 40 (4) is amended by striking out "works that council considers" and substituting "works the council considers".

539 Section 47 is amended by striking out "section 12 (1) (a)" and substituting "section 12 (1)".

540 Section 56 is amended

(a) in subsection (1) in the definition of "construction" by adding "other" before "structure" wherever it appears, and

(b) in subsection (2) (a) by adding "other" before "structures".

541 Section 91 (3) is amended by striking out "person" and substituting "persons".

542 Sections 101 (3), 102 (2), 103 (2), 105 (3), 106 (3), 107 (3) and 108 (2) are amended by striking out "local government office for the period established by" and substituting "an office described in, and for the period established by,".

543 Section 106 (1) (a) is amended by striking out "a member" and substituting "a council member".

544 Section 110 (2) is amended by adding "or Part I of the Vancouver Charter" after "Local Government Act".

545 Section 111 (2) (a) is amended by adding "of" before "at least".

546 Section 132 (3) (a) is amended by adding "member" after "presiding".

547 Section 143 (1) (b) is amended by striking out "regulatory authority;" and substituting "authority to regulate, prohibit and impose requirements;".

548 Section 215 (1) is amended in paragraph (b) of the definition "business promotion scheme" by striking out "buildings or structures" and substituting "buildings or other structures".

549 Section 224 (1) is amended by striking out "or (3)".

550 Section 276 (3) is amended by striking out "must respond to the those comments." and substituting "must respond to those comments."

551 Section 281 is amended

(a) in subsection (1) (a) by striking out "or require;" and substituting "and impose requirements;", and

(b) in subsection (2) (d) by adding "by alternative approval process" after "the approval of the electors".

552 Section 1 of the Schedule is amended

(a) in the definition of "alternative approval process" by striking out "elections" and substituting "electors",

(b) in the definition of "general bylaw" by striking out "138 (2)" and substituting "138",

(c) in the definition of "intermunicipal watercourse" by striking out "548 (1)" and substituting "548", and

(d) in paragraph (f) of the definition of "local authority" by adding "or the Local Government Act" after "of this Act".

Commencement

553 (1) Subject to subsections (2) to (9), this Act comes into force by regulation of the Lieutenant Governor in General.

(2) Sections 3 and 20 are deemed to have come into force on March 11, 2003 and are retroactive to the extent necessary to give them effect on and after that date.

(3) Sections 14 and 19 come into force on the day that the Community Charter receives Royal Assent and are retroactive to the extent necessary to have effect on and after that date.

(4) Section 40 comes into force on the day that section 205 of the Business Corporations Act, S.B.C. 2002, c. 57, comes into force.

(5) Section 42 comes into force on December 31, 2003 for the purposes of the 2004 and subsequent taxation years.

(6) Section 43 comes into force on the day that the Community Care and Assisted Living Act, S.B.C. 2002, c. 75, comes into force.

(7) Section 163, as it relates to the definitions of "regional park" and "regional trail", comes into force on the day that the Park (Regional) Act, R.S.B.C. 1996, c. 345, is repealed, and is retroactive to the extent necessary to have effect on and after that date.

(8) Section 307 comes into force on the day that the Manufactured Home Park Tenancy Act, S.B.C. 2002, c. 77, comes into force.

(9) The following sections are deemed to have come into force on February 19, 2003 and are retroactive to the extent necessary to give them effect on and after that date:

(a) section 41;

(b) section 265, as it enacts section 363.1 of the Local Government Act;

(c) section 330, and

(d) section 503, as it enacts section 2.1 (2) of the Vancouver Charter in relation to the application of section 193.1 of the Community Charter.

 
Explanatory Notes

SECTION 1: [Transitional -- Definitions] enacts definitions for the purposes of Part 1.

SECTION 2: [Transitional -- Deemed continuation of previous enactments] deems bylaw authority amended, repealed or replaced by this Act or the Community Charter to be continued if this Part provides for the continuation or for the continued application of bylaws enacted under the amended, repealed or replaced authority.

SECTION 3: [Transitional -- Interim regulations] authorizes the Lieutenant Government in Council to make transitional regulations to correct errors and resolve issues that arise in and from the transition to the Community Charter, but provides that such regulations have effect only until the last day of the session of the Legislative Assembly following the making of the regulations.

SECTION 4: [Transitional -- Continuation of municipal bylaws] continues the validity of a municipal bylaw enacted under an authority that has been repealed, until the bylaw is repealed or amended but authorizes the Lieutenant Governor in Council to continue by regulation the necessary authority for the bylaw, retroactive to the date the authority was repealed, amended or replaced, if amendment of the bylaw is required.

SECTION 5: [Transitional -- Counter petition opportunities in process] continues the application of the Local Government Act provisions respecting counter petition opportunities if notice was given of a counter petition opportunity before the repeal, amendment or replacement of the section requiring it and deems bylaws adopted following a counter petition opportunity under the Local Government Act to be bylaws adopted with the approval of the electors under the Community Charter.

SECTION 6: [Transitional -- Hazard and nuisance requirements in process] continues the authority and procedures under the Local Government Act in relation to dangerous buildings, hazardous trees and shrubs and declared nuisances if the procedures have been started under the Local Government Act before the replacement provision in the Community Charter comes into force.

SECTION 7: [Transitional -- Mayor's authority to require reconsideration] requires that the reconsideration procedures under the Local Government Act continue to apply in respect of matters voted on by a council before the replacement provision of the Community Charter comes into force.

SECTION 8: [Transitional -- Construction bylaws] continues the application of the Local Government Act in relation to local improvement projects that are or will be started within one year of the date the applicable provisions of the Local Government Act are repealed.

SECTION 9: [Transitional -- Heritage, riparian, cemetery and golf course exemptions and valuations] continues the application of the Local Government Act repayment provisions in relation to tax exemptions provided under that Act for heritage and riparian property and the application of the rules respecting golf course and cemetery valuation agreements for the life of any agreements made under those rules.

SECTION 10: [Transitional -- Irrigation bylaws] continues the application of the Local Government Act override of agreements respecting water for irrigation entered into by a person from whom the municipality acquired a licence or works by bylaws of the municipality.

SECTION 11: [Transitional -- Disposal of assets acquired with Provincial grants] requires notice to the Inspector of Municipalities if a municipality intends to dispose of lands, improvements or works acquired or constructed in whole or in part with Provincial grant funds and authorizes the Inspector to require repayment of those funds in accordance with the regulations authorized by the section.

SECTION 12: [Transitional -- Transfer of subdivision park land] makes a municipality's right in Crown property that vests in the municipality on the coming into force of the Community Charter subject to the same reservations to which the Crown's title was subject to.

SECTION 13: [Transitional -- Annual municipal report] disapplies, for the first year that an annual municipal report is prepared by a municipality under the Community Charter, the provisions of section 98 of the Community Charter that impose requirements based on requirements from the previous year's reporting.

SECTION 14: [Transitional -- Disclosure of gifts and personal benefits] requires persons who are subject to making disclosure under section 106 of the Community Charter to report gifts and personal benefits that are accepted between the date that the Community Charter receives Royal Assent and the date that Act comes into force.

SECTION 15: [Transitional -- Procedure bylaws] provides municipalities with 120 days after the Community Charter comes into force to adopt a procedure bylaw under section 124 of the Community Charter and provides procedural rules that apply in the meantime.

SECTION 16: [Transitional -- Special funds]

SECTION 17: [Transitional -- Parcel taxes] limits to one year the collection of parcel taxes imposed under the Local Government Act in relation to a service unless the parcel has the opportunity to be provided with the service as is required in relation to such a tax under the Community Charter.

SECTION 18: [Transitional -- Specified areas and business improvement areas] deems specified areas under the Local Government Act to be local service areas under the Community Charter and deems business improvement areas and mountain business improvement areas under the Local Government Act to be business improvement areas under the Community Charter.

SECTION 19: [Transitional -- Early enabling exemption agreements] enables municipalities to exercise the authority under section 225 of the Community Charter, by entering into exemption agreements and granting tax exemptions related to property described as eligible partnering property in section 225 (2) (a) of that Act, before section 225 of the Community Charter is brought into force and deems those agreements and exemptions to be agreements entered into and exemptions granted under that section of the Community Charter.

SECTION 20: [Transitional -- Regulations under this Act] makes section 6.6 (3) of the Local Government Act, enacted by this Act to authorize variations in regulations in relation to a number of factors, apply in relation to regulations under this Act.

 
Agricultural Credit Act

SECTION 21: [Agricultural Credit Act, repeals and replaces section 6 (2)] adds a reference to the Community Charter.

 
Assessment Act

SECTION 22: [Assessment Act, amends section 1 (1)] repeals the definition of "municipality" in order as a result of the application of this Act of the definition of "municipality" proposed for section 29 of the Interpretation Act by this Bill.

 
British Columbia Transit Act

SECTION 23: [British Columbia Transit Act, amends section 1 (1)] repeals the definition of "municipality" in order as a result of the application of this Act of the definition of "municipality" proposed for section 29 of the Interpretation Act.

SECTION 24: [British Columbia Transit Act, amends section 8] adds references to the Community Charter and to elector approval.

SECTION 25: [British Columbia Transit Act, amends section 19 (1) and (5)] adds references to the Community Charter.

SECTION 26: [British Columbia Transit Act, amends section 22] adds a reference to the Community Charter.

SECTION 27: [British Columbia Transit Act, amends section 25] removes references to the Local Government Act.

SECTION 28: [British Columbia Transit Act, amends section 26 (1) and (2)] adds references to the Community Charter.

 
Budget Measures Implementation Act, 2003

SECTION 29: [Budget Measures Implementation Act, 2003, repeals section 17] repeals a not in force provision that amended section 339 (1) (p) of the Local Government Act, which this Bill repeals.

 
Cemetery and Funeral Services Act

SECTION 30: [Cemetery and Funeral Services Act, amends section 1 (1)] repeals the definition of "municipality" in order as a result of the application of this Act of the definition of "municipality" added to section 29 of the Interpretation Act by this Bill.

SECTION 31: [Cemetery and Funeral Services Act, amends section 18 (1) (a) and (2) (a)] updates cross references to the Community Charter.

SECTION 32: [Cemetery and Funeral Services Act, repeals section 1 of the Supplement] repeals a not in force provision that is related to an amendment to section 340 of the Local Government Act, which this Bill repeals.

 
Coastal Ferry Act

SECTION 33: [Coastal Ferry Act, amends section 1] sets out the bodies that the definition of "qualified individual" includes, relying on the provisions of the Interpretation Act as they apply to the definitions of the Local Government Act and the Community Charter.

SECTION 34: [Coastal Ferry Act, amends section 30] repeals the definitions of "local government" and "municipality", enabling the division to rely on the definition of "local government" in the Local Government Act and updates cross references to the Community Charter.

 
Columbia Basin Trust Act

SECTION 35: [Columbia Basin Trust Act, amends section 6 (1)] updates a reference to the corporate officer.

SECTION 36: [Columbia Basin Trust Act, amends section 7 (1) (a)] updates a reference to the corporate officer.

 
Community Care and Assisted Living Act

SECTION 37: [Community Care and Assisted Living Act, amends section 1] revises this definition relying on the new general definition of municipality added to section 29 of the Interpretation Act by this Bill.

SECTION 38: [Community Care and Assisted Living Act, repeals sections 52 and 53] is consequential to the repeal of sections 339 and 341 of the Local Government Act.

 
Community Care Facility Act

SECTION 39: [Community Care Facility Act, amends section 1] revises this definition relying on the new general definition of municipality proposed for the Interpretation Act.

SECTION 40: [Community Charter, repeals and replaces section 169 (2) and (3)] is consequential to the Business Corporations Act.

SECTION 41: [Community Charter, enacts section 193.1] adds authority to establish, by bylaw, the manner in which interest is prescribed, consistent with section 59 of the Budget Measures Implementation Act, 2003.

SECTION 42: [Community Charter, amends section 220 (1) (q)] makes wording of the paragraph consistent with the wording of the Budget Measures Implementation Act.

SECTION 43: [Community Charter, repeals and replaces section 224 (2) (j)] amends this provision as a consequence of the new Community Care and Assisted Living Act.

SECTION 521: [Vancouver Charter, enacts Part XXIX] rewrites provisions respecting the protection of trees from the Local Government Act (Division 2 of Part 22) into the Vancouver Charter.

 
Vancouver Island Natural Gas Pipeline Act

SECTION 522: [Vancouver Island Natural Gas Pipeline Act, amends section 7] updates a reference to the Community Charter.

 
Waste Management Act

SECTION 523: [Waste Management Act, amends section 1] is consequential to the general definition of "municipality" proposed for the Interpretation Act.
