PROPOSED AMENDMENTS ON NOTICE

55   The Hon. J. Murray to move, in Committee of the Whole on Bill (No. 55) intituled Water, Land and Air Protection Statutes Amendment Act, 2003, to amend as follows:

SECTION 12, by deleting section 12 and substituting the following:

12 Section 14 (5) (b) of the Mineral Tenure Act, R.S.B.C. 1996, c. 292, is amended by striking out "or the Park (Regional) Act;" and substituting "or a regional park under the Local Government Act;".

SECTION 21, by deleting section 21.

SECTION 38, by deleting subsections (2) and (3) and substituting the following:

(2) Sections 14 (b) and (c) and 15 come into force by regulation of the Lieutenant Governor in Council.

56   The Hon. J. Murray to move, in Committee of the Whole on Bill (No. 56) intituled Flood Hazard Statutes Amendment Act, 2003, to amend as follows:

SECTION 19, in the proposed section 910 of the Local Government Act,

(a) by deleting subsection (2) and substituting the following:

(2) If land is designated as a flood plain under subsection (1), the local government may, by bylaw, specify

(a) the flood level for the floodplain, or different flood levels for different areas of the flood plain, and

(b) the setback from a watercourse, body of water or dike of any landfill or structural support required to elevate a floor system or pad above the flood level, which setback may be different for different areas of the floodplain and for different flood levels. , and

(b) by deleting subsection (4) and substituting the following:

(4) If a bylaw under subsection (2) applies,

(a) the underside of any floor system, or the top of any pad supporting any space or room, including a manufactured home, that is used for

(i) dwelling purposes,

(ii) business, or

(iii) the storage of goods which are susceptible to damage by floodwater

must be above the applicable flood level specified by the bylaw, and

(b) any landfill required to support a floor system or pad must not extend within any applicable setback specified by the bylaw.

SECTION 23, by deleting section 23 and substituting the following:

23 Section 16 comes into force on January 1, 2004.

60   The Hon. G. Collins to move, in Committee of the Whole on Bill (No. 60) intituled Business Corporations Amendment Act, 2003, to amend as follows:

SECTION 18, by deleting the proposed section 18.

72   The Hon. G. Collins to move, in Committee of the Whole on Bill (No. 72) intituled Manufactured Home Act, to amend as follows:

SECTION 7,

(a) by deleting the proposed subsection (2) and substituting the following:

(2) The regulations may require that notices respecting particular classes of transfers be submitted for filing only through persons specified by regulation or designated as qualified suppliers by the registrar. , and

(b) in the proposed subsection (5) by adding "or designated" after "specified".

SECTION 21,

(a) by deleting the proposed subsection (3) and substituting the following:

(3) The regulations may require that applications respecting particular classes of exemptions be submitted for filing only through persons specified by regulation or designated as qualified suppliers by the registrar. , and

(b) in the proposed subsection (4) by adding "or designated" after "specified".

SECTION 32, by deleting the proposed subsection (1) and substituting the following:

(1) Unless the manufactured home complies in all respects with the standards prescribed by regulation at the time it was manufactured or is exempted from this section by the regulations or by the registrar, a person must not move, sell, offer for sale or advertise for sale a previously unoccupied manufactured home or a manufactured home that was manufactured after May 15, 1992.

SECTION 33, by deleting the proposed section and substituting the following:

Disclosure statement to be provided to prospective purchaser

33 (1) A person must not sell or offer for sale a used or previously occupied manufactured home unless

(a) the person discloses in writing to any prospective purchaser whether or not the manufactured home complies with the standards prescribed by regulation, or

(b) the manufactured home is exempted from this section by the regulations or by the registrar.

(2) Subsection (1) does not apply if the person discloses in writing to any prospective purchaser that the manufactured home was manufactured on or before May 15, 1992.

SECTION 38, in the proposed subsection (5) by striking out "or 33" and substituting "or 33 (1)".

SECTION 47.1, by adding the following section:

Registry Statutes Amendment Act, 2002

47.1 Section 3 of the Registry Statutes Amendment Act, 2002, S.B.C. 2002, c. 17, is repealed.

78   The Hon. G. Abbott to move, in Committee of the Whole on Bill (No. 78) intituled Accountants (Chartered) Amendment Act, 2003, to amend as follows:

SECTION 18, by deleting the proposed section 18 and substituting the following:

18 Section 14 of the Accountants (Certified General) Act, R.S.B.C. 1996, c. 2, is repealed and the following substituted:

Right to use name "C.G.A."

14 (1) A member of the association may use the designation "certified general accountant", and may use after the member's name the initials "C.G.A.", indicating that the member is a certified general accountant.

(2) A person must not

(a) use or display the designation "certified general accountant" or the initials "C.G.A.", alone or in combination with any other word, name, title, initial, letter or description, or

(b) imply, suggest or hold out that the person is a certified general accountant unless the person is a registered member in good standing of the association.

(3) A person must not imply, suggest or hold out that the person is an accredited public accountant or use or display the designation "accredited public accountant" or the initials "A.P.A." signifying that designation.

(4) A person must not imply, suggest or hold out that the person is a certified public accountant or a certified public auditor or use or display the designation "certified public accountant" or "certified public auditor" or the initials "C.P.A." signifying that designation unless

(a) the person is a member in good standing of the association,

(b) the designation or initials are used or displayed together with and follow the designation "Certified General Accountant" or the initials "C.G.A.",

(c) the use or display is accompanied by the name of the jurisdiction where the designation "certified public accountant" or "certified public auditor" or the initials "C.P.A." were granted, and

(d) the jurisdiction where the designation "certified public accountant" or "certified public auditor" or the initials "C.P.A." were granted authorizes the person to use and display them in that jurisdiction.

(5) This section does not apply to the use or display of a designation or initials as provided for by section 17 of the Accountants (Chartered) Act.
