ENVIRONMENTAL TICKET ENFORCEMENT ACT

Preamble

WHEREAS the Province of British Columbia is blessed with a wide-array of beautiful parks, protected areas and waterways;

AND WHEREAS some visitors to these beautiful areas violate provincial laws by littering, damaging park property and fishing or hunting without a licence;

AND WHEREAS current legal mechanisms make it difficult to collect unpaid fines for ticket offences under certain provincial environmental statutes;

AND WHEREAS the collection rate is about 85% for fines levied under the Motor Vehicle Act and other statutes where unpaid fines result in a refusal to issue a British Columbia Driver's Licence;

AND WHEREAS the collection rate for fines under other provincial statutes is about 32%;

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Non-Payment of Fines

1 A person shall not have their British Columbia Driver's Licence renewed until such time as they have paid outstanding fines which have been assessed according to law for violating provisions of the Park Act, Wildlife Act, Fisheries Act, Forest Act, Forest and Range Practices Act, Integrated Pest Management Act, Firearm Act, Environmental Management Act and Water Act, or any regulations made pursuant to these statutes.

Regulations

2 The Lieutenant Governor in Council may make regulations referred to in section 41 of the Interpretation Act.

Commencement

3 This Act comes into force upon Royal Assent.
