CONFIRMATION OF PERSONAL OWNERSHIP
OF DNA ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions

1 In this Act:

"DNA" means deoxyribonucleic acid;

"DNA fingerprint" means, with respect to a person, a DNA pattern unique to that person.

Interpretation

2 A person has exclusive ownership of the DNA fingerprint of his body.

3 Except as provided herein no person shall use the DNA fingerprint of another person without the written consent of that person.

4 A person's DNA fingerprint may be used without that person's consent:

(a) in the investigation of a criminal offence;

(b) to identify a body;

(c) to assist in the search for a missing person;

(d) to identify a sex offender;

(e) where authorized by an enactment.

Commencement

5 This Act comes into force by regulation of the Lieutenant Governor in Council.

 
Explanatory Note:

This Bill sets out that a person's unique DNA pattern is their property except in specific situations.
