Be it resolved that this House urge the federal government to honour the full five years of the Federal-Provincial Agreement on Early Learning and Child Care to ensure the creation and availability of quality, affordable childcare spaces in BC.

NOTICE OF QUESTIONS

 2  Mr. Simons to ask the Hon. Minister of Children and Family Development the following questions:
1. Was the introduction of Kith and Kin agreements (also know as Section 8 Agreements) related to the budget cuts prescribed by the Ministry of Children and Family Development (MCFD)?
2. Was the enactment of Section 8 of the Child, Family and Community Service Act, known as "Kith and Kin" a part of the "service transformation?"
3. What were the other elements of service transformation besides regionalization and the introduction of Section 8 Agreements?
4. Prior to the service transformation, were child protection social workers already required by legislation or policy to place children who were unable to live in their own homes, whenever possible, with family members?
5. If child protection social workers were already required by legislation or policy to place children with family members when they needed to live away from their own home, what aspect of the service transformation was achieved with the introduction of the Kith and Kin program?
6. According to legislation, guidelines, policy, practice standards or any other regulation or directive, are Kith and Kin agreements permitted to be used in cases where a child is considered "at risk?"
7. According to legislation, guidelines, policy, practice standards or any other regulation or directive, are Kith and Kin agreements permitted to be used in situations deemed by child protection social workers to be "protection" cases, i.e. where protection concerns exist?
8. Between January of 2001 and December of 2002 was the authority to enter into Voluntary Care Agreements (also known as Section 6 Agreements) transferred from District Supervisors or Team Leaders to Regional MCFD staff?
9. Between January of 2001 and December of 2002 was the authority to approve Voluntary Care Agreements transferred from District Supervisors or Team Leaders to Regional MCFD staff?
10. According to legislation, guidelines, policy, practice standards or any other regulation or directive, are Voluntary Care Agreements permitted to be used in situations deemed by child protection social workers to be "protection" cases, i.e. where protection concerns exist?
11. According to legislation, guidelines, policy, practice standards, regulation or directive, are Kith and Kin agreements considered a "less disruptive" measure than Voluntary Care Agreements?
12. In 2002 was a First Nations Child Welfare Agency with partial (limited) delegation (known as "Level 13" or "Guardianship" delegation) permitted to enter into Kith and Kin agreements?
13. In 2002 was a First Nations Child Welfare Agency with partial (limited) delegation permitted to enter into Voluntary Care Agreements?
14. Has the Ministry reviewed the death of the other toddler who died while in the care of Ryan Dexter GEORGE?
15. Will the Ministry re-open the case of the child who died in the care of Ryan Dexter GEORGE in 1998?
16. Was the original purpose of the "Previous Contact Checks" (also known as PCC's), to permit social workers to ascertain if, how often, and when, a subject family of an Intake has had previous involvement with the MCFD?
17. Is the PCC an electronic summary of the MCFD case file?
18. Is the use of the PCC as a part of a "Pre-Agreement Check" on a prospective Kith and Kin care home, a new use of the PCC?
19. Are there any other uses of a PCC?
20. Does a PCC include any background material or supporting documentation including reports or assessments, associated with a file?
21. Do the Kith and Kin guidelines require a social worker to review the physical (paper) file of the prospective caregiver prior to assenting to the placement?
22. Would the correct PCC on Ryan Dexter GEORGE and Claudette LUCAS have provided an accurate reflection of the contents of the physical file?
23. Prior to the enactment of Kith and Kin legislation, what agreement had been reached between the MCFD and the Federal Department of Indian and Northern Affairs regarding the program's funding on-reserve?
24. Have any amendments to the "Memorandum of Understanding" (known colloquially as "20-1") been made since 1996 or prior to the enactment of Kith and Kin legislation?
25. Was the "Tsawwassen Accord" an agreement between First Nations political leadership and the Province?
26. What is the relationship between Chiefs and Councils, Band Councils, Tribal Councils or their equivalents, to Delegated First Nations Child Welfare Agencies?
27. Do First Nations Child Welfare Agencies operate independently of political involvement of Chiefs and Councils, Band Councils or Tribal Councils?
28. Did discussions leading to the Tsawwassen Accord include any Directors of First Nations Child Welfare Agencies?
29. Which Director(s) of Delegated First Nations Child Welfare Agencies did the Province consult with in the development or ratification of the Tsawwassen Accord?
30. What evidence does the Ministry have indicating Delegated First Nations Child Welfare Agency support for the process known as "Regionalization"?
31. How many times has the First Nations Child Welfare Agency Directors (collectively known as the "Director's Forum") requested the establishment of a position of "Director of First Nations Child Welfare"?
32. Does the MCFD foresee Regional Aboriginal Authorities as including both on- and off-reserve service providers?
33. Does the MCFD foresee Regional Aboriginal Authorities being responsible for children both on- and off-reserve?
34. What will the Province MCFD do regarding the Hon. Ted Hughes' recommendation #12?
