HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:
Parks and Protected Areas Statutes Amendment Act, 2007
SECTION 1: [Parks and Protected Areas Statutes Amendment Act, 2007, section 4] modifies a not-in-force amendment to the description of Anhluut'ukwsim Laxmihl Angwinga'asanskwhl Nisga'a, consequential to an amendment to the description of the same park by this Bill.
1 Section 4 (a) of the Parks and Protected Areas Statutes Amendment Act, 2007, S.B.C. 2007, c. 27, is repealed and the following substituted:
(a) in the description of Anhluut'ukwsim Laxmihl Angwinga'asanskwhl Nisga'a by striking out everything after "being the point of commencement." and substituting the following:
except (1) the Nisga'a Highway No. 113 as shown on Plan 6 Tube 1870 deposited in the Crown Land Registry; (2) from the north boundary of Plan 6 Tube 1870 heading in a northerly direction to the middle thread of Jay Creek, a 20 metre wide area of land centred on Nisga'a Highway No. 113; (3) from the middle thread of Jay Creek heading in a northerly, westerly and easterly direction to the east and west boundaries of the park, a 25 metre wide strip of land centred on all branches of Nisga'a Highway No. 113; (4) all land on which a provincial public undertaking, as defined in the Transportation Act, related to Nisga'a Highway No. 113 is located; (5) Anlaw Road as shown on Plan 11 Tube 1711 deposited in the Crown Land Registry; and (6) the New Aiyansh Village proposed south access road shown in Figure 4.1 of the October 2006 report titled "New Aiyansh Village Government, Proposed South Access Road, Nisga'a Memorial Lava Bed Park — Boundary Adjustment Request", on file 84220-25-0386 in BC Parks and Protected Areas Program office in Victoria.

2 Schedule A of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended
(a) by adding the following descriptions:
All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Queen Charlotte District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 1991.
The whole ecological reserve containing approximately 1.5 hectares.
All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Queen Charlotte District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 1990.
The whole ecological reserve containing approximately 9 174 hectares (8 057 hectares of upland and 1 117 hectares of foreshore). , and
(b) in the description of San Juan River Estuary Ecological Reserve by striking out "Plan 3 Tube 1950." and substituting "Plan 13 Tube 1911."
SECTION 3: [Protected Areas of British Columbia Act, Schedule B] removes references to 2 ecological reserves moved by this Bill to Schedule A.
3 Schedule B is amended
(a) by striking out "Lepas Bay Ecological Reserve, established by Order in Council 2751/78" , and
(b) by striking out "Vladimir J. Krajina (Port Chanal) Ecological Reserve, established by Order in Council 1827/73".
SECTION 4: [Protected Areas of British Columbia Act, Schedule C]
4 Schedule C is amended
(a) by adding the following descriptions:
All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 2, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 1989.
The whole park containing approximately 132 hectares (89 hectares of upland and 43 hectares of foreshore).
All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Osoyoos Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 1876; except (1) Silver Star Road right of way as shown on Ministry of Highways Drawings numbered 67/1306-2 and 67/1306-3 filed in the Vernon Highway District Office (Gazetted July 12, 1984); and (2) Sovereign Lake Access Road as shown on Crown Land Registry Plan 1 Tube 1533.

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 15 Tube 1904; except (1) the right of way of the Caribou Highway No. 97 as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 435; (2) the new right of way for Highway No. 97 shown on Ministry of Transportation plans titled "For Right-of-Way Acquisition, Highway No. 97, Wright Station Curves, Drawing No. R2-640-103RW and Drawing No. R2-640-104RW" on file with the Ministry of Transportation Kamloops Regional Office; and (3) the transmission line right of way as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 528.

(a) by repealing the description of Birkenhead Lake Park and substituting the following:

6 Schedule D is amended

SECTION 12: [Sea to Sky conservancies] authorizes the Lieutenant Governor in Council to rename the conservancies described in section 10 and deems the official plans related to those conservancies amended at the same time to reflect the new names.
12 (1) The Lieutenant Governor in Council may rename a conservancy described in section 10 by regulation made on or before the effective date of the regulation under section 14 bringing the description of that conservancy into force.
(2) On the date a conservancy is renamed under subsection (1), the official plan referred to in the description of the conservancy is deemed amended to reflect the new name.
SECTION 13: [Rescission of orders in council] rescinds the establishment by order in council of ecological reserves, a park, a conservancy and a protected area as these have been established as ecological reserves, parks or conservancies under the Act.
13 The following orders in council are rescinded:
(a) the establishment of Vladimir J. Krajina (Port Chanal) Ecological Reserve, by Order in Council 1827/73;
(b) the establishment of Lepas Bay Ecological Reserve by Order in Council 2751/78;
(c) the establishment of Huchsduwachsdu Nuyem Jees/Kitlope Heritage Conservancy Protected Area by Order in Council 194/96;
(d) the establishment of Kalamalka Lake Protected Area by Order in Council 523/2001;
(e) the continuation of Silver Star Park by Order in Council 636/2004.

SECTION 1: [Parks and Protected Areas Statutes Amendment Act, 2007, section 4] modifies a not-in-force amendment to the description of Anhluut'ukwsim Laxmihl Angwinga'asanskwhl Nisga'a, consequential to an amendment to the description of the same park by this Bill.

SECTION 3: [Protected Areas of British Columbia Act, Schedule B] removes references to 2 ecological reserves moved by this Bill to Schedule A.
SECTION 4: [Protected Areas of British Columbia Act, Schedule C]
SECTION 5: [Protected Areas of British Columbia Act, Schedule C]
SECTION 6: [Protected Areas of British Columbia Act, Schedule D]
SECTION 7: [Protected Areas of British Columbia Act, Schedule D] adds 6 new Class A parks.
SECTION 8: [Protected Areas of British Columbia Act, Schedule E]
SECTION 9: [Protected Areas of British Columbia Act, Schedule E]
SECTION 10: [Protected Areas of British Columbia Act, Schedule E] establishes 2 new conservancies.
SECTION 11: [Protected Areas of British Columbia Act, Schedule F] establishes 6 new conservancies.
SECTION 12: [Sea to Sky conservancies] authorizes the Lieutenant Governor in Council to rename the conservancies described in section 10 and deems the official plans related to those conservancies amended at the same time to reflect the new names.
SECTION 13: [Rescission of orders in council] rescinds the establishment by order in council of ecological reserves, a park, a conservancy and a protected area as these have been established as ecological reserves, parks or conservancies under the Act.
