PROTECTED AREAS OF BRITISH COLUMBIA
AMENDMENT ACT, 2010

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

SECTION 1: [Protected Areas of British Columbia Act, Schedule A] enacts in Schedule A descriptions of 2 ecological reserves that were previously established as ecological reserves by order in council.

1 Schedule A of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended by adding the following descriptions:

MERIDIAN ROAD (VANDERHOOF) ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 4 Coast District and Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 1979.

The whole ecological reserve containing approximately 262 hectares.

STOYOMA CREEK ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 1999; except a 20 metre right of way centred on Ministry of Forests and Range road FSR 7972-03, Uztilius-Stoyoma.

The whole ecological reserve containing approximately 71 hectares.

SECTION 2: [Protected Areas of British Columbia Act, Schedule B] removes reference to the 2 ecological reserves that are added to Schedule A by this Bill.

2 Schedule B is amended

(a) by striking out "Meridian Road (Vanderhoof) Ecological Reserve, established by Order in Council 3772/77", and

(b) by striking out "Stoyoma Creek Ecological Reserve, established by Order in Council 1034/90".

SECTION 3: [Protected Areas of British Columbia Act, Schedule C]

3 Schedule C is amended

(a) by repealing the descriptions of Brandywine Falls Park, Buccaneer Bay Park, Sasquatch Park, Skihist Park and Valhalla Park and substituting the following descriptions:

BRANDYWINE FALLS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 1, New Westminster District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 1999; except (1) the land shown on Highway Plan H-105, LTO Plan BCP 31821 and LTO Plan BCP 40130, except that part included within "Reference Plan of Closed Road Dedicated on Highway Plan H-105 and BCP 31821, D.L. 4098, and as shown on Highway Plan H-104, D.L. 4099, Group 1, New Westminster District", as shown on Bunbury & Assoc. drawing W-3551-1, on file at the Ministry of Environment, Parks and Protected Areas Division, Victoria; (2) District Lot 2945; and (3) LTO Plan BCP24386.

The whole park containing approximately 420 hectares.

BUCCANEER BAY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Group 1, New Westminster District and contained within described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 1999.

The whole park containing approximately 45 hectares (0.5 hectares of upland and 44.5 hectares of foreshore).

SASQUATCH PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Yale Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 2003; except Rockwell Drive as shown on Ministry of Transportation and Infrastructure's District Plan 55-17.

The whole park containing approximately 1 229 hectares.

SKIHIST PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kamloops Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 1995; except the Trans-Canada Highway No. 1, as shown on the Official Plans deposited in the Crown Land Registry as Plan 3 Tube 996 and Plan 13 Tube 1615.

The whole park containing approximately 386 hectares.

VALHALLA PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kootenay District and contained within the following described boundaries:

Firstly: all those parcels or tracts of Crown land, together with all that foreshore or land covered by water, contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 1806; except (1) District Lots 8938 and 12795; and (2) Evans Lake Ecological Reserve shown on the Official Plan deposited in the Crown Land Registry as Plan 26 Tube 1914.

Secondly: commencing at the point of intersection of the southwest corner of District Lot 10030 and the westerly shore natural boundary of Slocan Lake;

thence due East 100 metres;

thence in a general northerly direction along a line parallel to and 100 metres perpendicularly distant from the westerly shore natural boundary of Slocan Lake to a point lying due East of the point of intersection of the north boundary of Valhalla Park and the westerly shore natural boundary of Slocan Lake, as shown on Official Plan 14 Tube 1806, referred to above;

thence due West to the point of intersection of the north boundary of Valhalla Park and the westerly shore natural boundary of Slocan Lake, as shown on Official Plan 14 Tube 1806, referred to above;

thence in a southerly direction along the westerly shore natural boundary of Slocan Lake to the point of commencement;

except the 100 metre strip fronting District Lots 6521, 7686, 10396 and Block A, Plan 2271 of District Lot 1253.

Thirdly: District Lot 8223.

The whole park containing approximately 50 060 hectares. ,

(b) in the description of Dry Gulch Park by striking out "Plan 35 Tube 1802." and substituting "Plan 35 Tube 1802; except a 20 metre right of way centred on Dry Gulch Campsite Road.",

(c) in the description of Ellison Park by striking out "except a 20 metre right of way centred on the existing Eastside Road." and substituting "except Eastside Road as shown on the plan entitled "Reference Plan of Road in the East 1/2 of Sec. 33, and the Frac, north-west 1/4 of Sec. 33; all of TP, 14, O.D.Y.D.", prepared by Russell N. (d) in the description of Eskers Park by striking out "Plan 2 Tube 1847; except the northeast 1/4 of District Lot 2734." and substituting "Plan 2 Tube 1847." and by striking out "3 979 hectares." and substituting "4 044 hectares.",

(e) in the description of Johnstone Creek Park by striking out everything after "Plan B 3224." and before "The whole park" and substituting the following:

That part of the east 1/2 of the southeast 1/4 of Lot 229, which lies to the south of the southerly limit of the right of way of Highway No. 3 and that part of the east 1/2 of the southwest 1/4 of Lot 229 which lies to the southeast of the southeasterly limit of the right of way of Highway No. 3; except the land within the following described boundaries:

(i) in the description of Tyhee Lake Park by striking out "Township 5, Range 5, Coast District" and substituting "Townships 4 and 5, Range 5 Coast District" and by striking out everything after "thence southerly along the natural boundary of Tyhee Lake to the point of commencement." and substituting the following:

Thirdly: Lot 6, Section 2, Township 4, Range 5 Coast District, Plan 10278; except that part subdivided by Plan EPP242.

The whole park containing approximately 39 hectares. , and

(j) in the description of Upper Lillooet Park by striking out "except (1) Mineral Claim "GPC #1" 332441; and (2) Ministry of Forests' Cutting Permit 50, Block 5-003." and substituting "except (1) Mineral Claim "GPC #1" 332441; and (2) Mineral Claim "GPC #8" 332448."

SECTION 4: [Protected Areas of British Columbia Act, Schedule C] amends the description of Otter Lake Park to remove 2 existing roads.

4 Schedule C is amended in the description of Otter Lake Park by striking out everything after "District Lot 597." and substituting the following:

Lot 1 of District Lot 596, Plan 27220; except (1) Lease of Placer Minerals 385354; (2) that part of Lot 1 lying south of Lease of Placer Minerals 385354; (3) a 10 metre right of way centred on the non-status road entering the park from Coalmont Road at UTM Zone 10 North 5495031 metres +/- East 660850 metres +/- and exiting the park on the westerly boundary at UTM Zone 10 North 5494806 metres +/- East 660872 metres +/-; and (4) a 30 metre right of way centred on Coalmont Road and all land on which a provincial public undertaking, as defined in the Transportation Act, related to Coalmont Road is located.

The whole park containing approximately 49 hectares.

SECTION 5: [Protected Areas of British Columbia Act, Schedule D]

5 Schedule D is amended

(a) in the description of Cariboo River Park by striking out everything after "being the point of commencement;" and substituting the following:

except (1) Lease of Placer Minerals 365850; (2) a 30 metre right of way centred on Ministry of Forests and Range road FSR 7678-01, Cunningham Pass; and (3) a 10 metre right of way centred on the non-status road entering the park at UTM Zone 10 North 5855319 metres +/- East 616959 metres +/- and exiting the park at UTM Zone 10 North 5855675 metres +/- East 617315 metres +/-.

The whole park containing approximately 3 211 hectares. ,

(b) by repealing the description of Skaha Bluffs Park and substituting the following:

SKAHA BLUFFS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Similkameen Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 2003.

The whole park containing approximately 489 hectares. , and

(c) by adding the following description:

SOUTH CHILCOTIN MOUNTAINS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 1995.

The whole park containing approximately 56 796 hectares.

SECTION 6: [Protected Areas of British Columbia Act, Schedule D]

6 Schedule D is amended

(a) by repealing the description of Beaver Creek Park and substituting the following:

BEAVER CREEK PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kootenay District and contained within the following described boundaries:

Firstly: all those parcels or tracts of Crown land, together with all that foreshore or land covered by water, contained with the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 1929.

Secondly: Lot A, Lot 205, Plan NEP82552.

The whole park containing approximately 89 hectares. ,

(b) by adding the following descriptions:

BRIDGE RIVER DELTA PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 1995.

The whole park containing approximately 992 hectares.

FRED ANTOINE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 1995; except a 30 metre right of way centred on Lillooet-Pioneer Road No. 40 and all land on which a provincial public undertaking, as defined in the Transportation Act, related to Lillooet-Pioneer Road No. 40 is located.

The whole park containing approximately 8 230 hectares.

FRENCH BAR CREEK PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 1995; except a 50 metre corridor between the south and north boundaries of the park centred on the following UTM Zone 10 coordinates: North 5675125 metres East 558046 metres, North 5675200 metres East 558041 metres, North 5675230 metres East 558008 metres, North 5675244 metres East 558011 metres, North 5675275 metres East 558043 metres, North 5675352 metres East 558041 metres, North 5675436 metres East 558044 metres, North 5675477 metres East 558046 metres, North 5675598 metres East 558041 metres, North 5675728 metres East 558027 metres, North 5675824 metres East 557997 metres.

The whole park containing approximately 1 159 hectares.

GWYNETH LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 1995; except a 30 metre right of way centred on Ministry of Forests and Range permit road R12581-1-D.

The whole park containing approximately 132 hectares.

MARBLE CANYON PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water situated in Kamloops Division, Yale District and Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 1995; except (1) the BC Hydro right of way described by: District Lot 7954, District Lot 7943, District Lot 7942 in Lillooet District, District Lot 5469 Kamloops Division, Yale District and right of way Plan CG 257; (2) a 30.5 metre right of way centred on the Sea-to-Sky Highway No. 99 and all land on which a provincial public undertaking, as defined in the Transportation Act, related to Sea-to-Sky Highway No. 99 is located; and (3) a 30 metre right of way centred on Ministry of Forests and Range road FSR 7670-01, Tom Cole.

The whole park containing approximately 2 544 hectares.

OREGANA CREEK PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kamloops Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 1852; except (1) a 30 metre right of way centred on the Ministry of Forests and Range road FSR 0565-03, Finn-Tum from the west boundary of the park to the middle thread of Oregana Creek; (2) a 40 metre right of way 25 metres perpendicularly distant easterly and 15 metres perpendicularly distant westerly from the centerline of Ministry of Forests and Range road FSR 0565-03, Finn-Tum lying north of the middle thread of Oregana Creek; (3) a 30 metre right of way centred on Ministry of Forests and Range permit road R15237, Bear Spur; (4) a 30 metre right of way centred on Ministry of Forests and Range permit road R15236-1200; (5) a gravel pit contained within the described boundaries in UTM Zone 11 commencing at the junction of the centre lines of roads FSR 0565-03, Finn-Tum and R15236-1200 at UTM North 5761520 metres +/-, thence southerly along the centre line of road R15236-1200 to UTM North 5761335 metres, thence to UTM North 5761335 metres East 356820 metres, thence to UTM North 5761465 metres East 356820 metres, thence to the point of commencement; and (6) a 50 metre right of way 40 metres perpendicularly distant westerly and 10 metres perpendicularly distant easterly from the centre line of Ministry of Forests and Range permit road R15236-1100.

YALAKOM PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 1995.

The whole park containing approximately 8 941 hectares. ,

(c) by repealing the description of Francis Point Park and substituting the following:

FRANCIS POINT PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in New Westminster District and contained within the following described boundaries:

Firstly: all those parcels or tracts of Crown land, together with all that foreshore or land covered by water, contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 1910.

Secondly: Lot 108, Block 2, District Lot 1362, Plan 19329.

The whole park containing approximately 83 hectares (74 hectares of upland and 9 hectares of foreshore). ,

(d) by repealing the description of Gilpin Grasslands Park and substituting the following:

GILPIN GRASSLANDS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Similkameen Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2005; except (1) Highway No. 3; (2) that part of District Lot 264 shown on the plan attached to Changes Parcel Book, Volume 3, Folio 350, No. 2778B Similkameen Division, Yale District; (3) that part of District Lot 265 included in the plan attached to Changes Parcel Book, Volume 3, Folio 350, Similkameen Division, Yale District; (4) a 30 metre right of way centred on Ministry of Forests and Range road FSR 6316-01, Gilpin Creek; and (5) a 20 metre Statutory Right of Way CA932291, on file in the Land Title Office, Kamloops.

The whole park containing approximately 912 hectares. ,

(e) in the description of Mount Robson Park by striking out everything after "(all on Plan 28792);" and before "Thirdly:" and substituting "(7) the Grand Trunk Pacific Railway right of way designated as District Lot 3743 on Plan C.G. 122; (8) the Canadian Northern Pacific Railway right of way designated as District Lots 3736 and 3745 on Plans C.G. 122 and C.G. 126, respectively, with all plans being on deposit in the Land Title Office in Prince George; (9) those parcels shown in Railway Expansion Report dated December 12, 1989, filed on Parks Branch File 2-4-3-1-24; and (10) all those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plans deposited in the Crown Land Registry as Plan 1 Tube 1983, Plan 2 Tube 1983 and Plan 3 Tube 1983.",

(f) in the description of Mount Robson Park by striking out everything after "except District Lot 5677." and substituting the following:

(g) by repealing the name of Nanika-Kidprice Park and substituting the following:

SECTION 7: [Protected Areas of British Columbia Act, Schedule E]

7 Schedule E is amended

(a) by adding the following description:

MKWAL'TS CONSERVANCY

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 1980; except (1) a 30 metre right of way centred on Ministry of Forests and Range road FSR 7979-01; and (2) a 30 metre right of way centred on Ministry of Forests and Range permit road R08887, Section SM-ML.

The whole conservancy containing approximately 3 874 hectares. , and

(b) in the description of Ẁaẁley/Seymour Estuary Conservancy by striking out "Plan 10 Tube 1969." and substituting "Plan 10 Tube 1969; except the land subject to the Ministry of Forests and Range Special Use Permit S22747." and by striking out "327 hectares (290 hectares of upland and 37 hectares of foreshore)." and substituting "326 hectares (289 hectares of upland and 37 hectares of foreshore)."

SECTION 8: [Protected Areas of British Columbia Act, Schedule F] amends the description of Neğiy/Nekite Estuary Conservancy to remove land.

8 Schedule F is amended in the description of Neğiy/Nekite Estuary Conservancy

(a) by striking out "except a 30 metre right of way centred on Ministry of Forests and Range road FSR 8366." and substituting "except (1) a 30 metre right of way centred on Ministry of Forests and Range road FSR 8366; and (2) the land and water contained within the boundaries described as follows: commencing at UTM Zone 9 North 5693610 metres East 630700 metres; thence to the easterly 15 metre offset from the centre line of road FSR 8366-01, Nekite Mainline, at UTM Zone 9 North 5693610 metres East 630611 metres +/-; thence northerly along the easterly 15 metre offset from FSR 8366-01, Nekite Mainline, to UTM Zone 9 North 5693930 metres East 630569 metres +/-; thence to UTM Zone 9 North 5693930 metres East 630700 metres; thence to UTM Zone 9 North 5693610 metres East 630700 metres, being the point of commencement.", and

(b) by striking out "485 hectares (333 hectares of upland and 152 hectares of foreshore)." and substituting "481 hectares (331 hectares of upland and 150 hectares of foreshore)."

SECTION 9: [Rescission of orders in council] rescinds the establishment by order in council of one park that is added to the schedule by this Bill and 2 ecological reserves that are moved from Schedule B, which continues ecological reserves by reference to the order in council under which they were established, to Schedule A, which establishes or continues ecological reserves by description.

9  The following orders in council are rescinded:

(a) the establishment of Juniper Beach Park by Order in Council 888/1989;

(b) the establishment of Meridian Road (Vanderhoof) Ecological Reserve by Order in Council 3772/77;

(c) the establishment of Stoyoma Creek Ecological Reserve by Order in Council 1034/90.

SECTION 10: [Rescission of order in council] rescinds the establishment of Spruce Lake Protected Area by order in council under the Environment and Land Use Act.

10  Despite section 7 (1) of the Environment and Land Use Act, the establishment of Spruce Lake Protected Area by Order in Council 524/2001 is rescinded.

11  The provisions of this Act referred to in column 1 of the following table come into force as set out in column 2 of the table:

SECTION 6: [Protected Areas of British Columbia Act, Schedule D]

SECTION 7: [Protected Areas of British Columbia Act, Schedule E]

SECTION 8: [Protected Areas of British Columbia Act, Schedule F] amends the description of Neğiy/Nekite Estuary Conservancy to remove land.

SECTION 9: [Rescission of orders in council] rescinds the establishment by order in council of one park that is added to the schedule by this Bill and 2 ecological reserves that are moved from Schedule B, which continues ecological reserves by reference to the order in council under which they were established, to Schedule A, which establishes or continues ecological reserves by description.

SECTION 10: [Rescission of order in council] rescinds the establishment of Spruce Lake Protected Area by order in council under the Environment and Land Use Act.
