PROPOSED AMENDMENTS ON NOTICE

Hon. S. Thomson to move, in Committee of the Whole on Bill (No. 2) intituled Flathead Watershed Area Conservation Act to amend as follows:

SECTION 1, by deleting the text shown as struck out:

“Flathead watershed area” means all those parcels or tracts of land that on November 9, 2009, were situated in the Kootenay District and contained within the boundaries as shown on the official plan for the Flathead Watershed Area, deposited in the Media Vault, GeoBC, Victoria as Official Plan: Flathead Watershed Area, dated November 9, 2009;, but does not include the following:

(a) a park, recreation area or conservancy, as those terms are defined in section 1 of the Park Act;

(b) an ecological reserve under Schedule A or Schedule B to the Protected Areas of British Columbia Act;

(c) an area established as a protected area by order in council under the Environment and Land Use Act

Hon. S. Thomson to move, in Committee of the Whole on Bill (No. 2) intituled Flathead Watershed Area Conservation Act to amend as follows:

SECTION 1, by deleting the text shown as struck out and adding the text shown as underlined:

“mineral claim” “mineral title” has the same meaning as in the Mineral Tenure Act;

SECTION 5, by adding the following subsection:

(1.1) The chief gold commissioner must not exercise the power under section 21 (3) of the Coal Act to cancel all or part of the coal land reserve established under this Act.

SECTION 5, by deleting the text shown as struck out and adding the text shown as underlined:

(3) A free miner must not register a mineral claimtitle in the mineral reserve established under subsection (2).

Mr. B. Simpson to move, in Committee of the Whole on Bill (No. 6) intituled Forests, Lands and Natural Resource Operations Statutes Amendment Act, 2011 to amend as follows:

SECTION 4 is amended

(a) in subsection 47.1 (1) by adding “providing criteria in subsection (3) have been met.” after “licence

(b) by adding the following subsection:

(3) In order to remove private land from a woodlot licence area

(a) the woodlot licence must have been operative for a minimum of 10 years;

(b) the cut under the woodlot licence must be in balance and all regulatory requirements must have been met, or compensation has been received by government for any non-compliance;

(c) notice has been given to the public of the application to remove the land and a period of not less than 90 days has been provided to the public to give feedback to the Minister on the potential removal;

(d) notice has been given to local governments of the application for removal; and

(e) compensation to the Crown has been negotiated commensurate with the relative value of the private land’s contribution to the original licence.

(c) by adding the following subsection:

(4) Following a removal of private land under section (2), the Minister must notify the public of the change in boundaries.

SECTION 5, by deleting the text shown as struck out and adding the text shown as underlined:

47.3 (1) (c) if the licence is a fibre supply licence to cut, and in the opinion of the Minister as prescribed by regulation, Crown timber is required for the purpose of
