PROPOSED AMENDMENTS ON NOTICE

31  Hon. S. Bond to move, in Committee of the Whole on Bill (No. 31) intituled Motion Picture Amendment Act, 2012 to amend as follows:

SECTION 9, as it amends section 12 (2), by deleting the text shown as struck out:

(2) An inspector who conducts an inspection under subsection (1) (a) may seize

(a) any motion picture, or a copy of any motion picture, that the inspector believes will be exhibited in a theatre and

(i) that has not been reviewed or approved, as applicable, by the director under section 5, or

(ii) that does not have attached to it a certificate or other evidence as required under section 2,

SECTION 16, by deleting the text shown as struck out and adding the text shown as underlined:

Protected Information

16 (1)  Except as permitted under section 17 [duty to keep information confidential] or 18 [personal information], a person must refuse, despite the Freedom of Information and Protection of Privacy Act, to disclose the following: a person described in section 17 (1) or 18 (1) must refuse to disclose the following:

(a) information that would identify the person responsible for an animal or an animal product or byproduct;

(b) information that would identify an animal or an animal product or byproduct that is located at or in a specific place or on or in a specific vehicle;

(c) information that would reveal that a notifiable or reportable disease is or may be present in a specific place or on or in a specific vehicle;

(d) information that would reveal that an animal or an animal product or byproduct affected by a notifiable or reportable disease is

(i) located at or in a specific place or on or in a specific vehicle, or

(ii) owned, or in the custody or control of, an identifiable person or body, or that an identifiable person or body is an operator in relation to the animal or the animal product or byproduct;

(e) information that is derived from a sample taken under this Act or that is submitted to the ministry of the minister or a laboratory identified in an order of the minister.

(2) Despite the Freedom of Information and Protection of Privacy Act, a person who would otherwise be required under that Act to disclose information described in subsection (1) of this section must refuse to disclose the information.

SECTIONS 118.1 and 118.2, by adding the following heading and sections:

Amendments to this Act

118.1 Section 17 is amended

(a) in subsection (1) (d) and (e) by striking out “section 16 (e)” and substituting “section 16 (1) (e)”, and

(b) in subsection (2) by striking out “section 16” and substituting “section 16 (1)”.

118.2 Section 18 (1) (d) and (e) is amended by striking out “section 16 (e)” and substituting “section 16 (1) (e)”.

38  Hon. K. Falcon to move, in Committee of the Whole on Bill (No. 38) intituled Pension Benefits Standards Act to amend as follows:

SECTION 58, by adding the following subsection:

(4) If there is, in respect of a participating employer, a proceeding

(a) under the Companies Creditors Arrangement Act (Canada),

(b) under the Winding-up and Restructuring Act (Canada) or similar provincial legislation,

(c) in relation to liquidation, receivership or secured creditor enforcement, or

(d) in relation to insolvency other than under the Bankruptcy and Insolvency Act (Canada),

an amount equal to the amounts deemed to be held in trust under subsection (1) is deemed to be separate and apart from, and to form no part of, the estate of the participating employer, whether or not that amount has in fact been kept separate and apart from the participating employer’s own assets or from the assets of the estate.

SECTION 79, by deleting proposed section 79 (1) (a) (i) and substituting the following:

(i) subject to subsection (3), the pension to which the member was entitled must be provided to the surviving spouse

(A) as a pension, or

(B) by way of a transfer of the commuted value of the pension under Division 7, and the surviving spouse has, in relation to that transfer, the same rights and obligations, if any, that would have applied to the member had the member survived;

51  Hon. B. Lekstrom to move, in Committee of the Whole on Bill (No. 51) intituled South Coast British Columbia Transportation Authority Amendment Act, 2012 to amend as follows:

SECTION 16, by deleting proposed section 258 (4) and substituting the following:

(4) A certificate may not be filed under subsection (1),

(a) subject to paragraph (b), more than 2 years after the date on which, under subsection (2), the authority is first able to file a certificate, or

(b) if a review is sought under section 257, more than 2 years after the later of

(i) the date on which the claim is withdrawn, and

(ii) the date on which the court makes a final determination of the claim that does not relieve the applicant from liability under the ticket.

SECTION 16, in proposed section 260 by deleting “ticketed amount.” and substituting “indebtedness.

SECTION 16, in proposed section 261 (2), by adding the text shown as underlined:

(2) The authority may assign to a person, including, without limitation, the Minister of Finance on behalf of the government, on any terms or conditions the authority and the assignee may agree, all of the authority’s right, title and interest in and to indebtedness to the authority under section 250, including, without limitation, all surcharges and interest that, under this Act and the fare collection bylaw, have accrued and may accrue in relation to all or any part of the indebtedness.

SECTION 16, in proposed section 261 (4), by striking out “and” at the end of paragraph (a), by adding “, and” at the end of paragraph (b) and by adding the following paragraph:

(c) any payment required to be made by the government to the authority under or by virtue of the assignment may be paid out of the consolidated revenue fund.
