THE CULTUS LAKE PARK
AMENDMENT ACT, 2014

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 4 of The Cultus Lake Park Act, S.B.C. 1932, c. 63, is repealed and the following substituted:

Membership

4  The Board shall be and is constituted a body politic and corporate and shall consist of 5 members, 2 of whom shall represent the District of Chilliwack, and 3 of whom shall represent the residents of Cultus Lake Park and referred to hereafter as "Cultus Lake representatives".

2 Section 5 (b) is amended by striking out "The two Cultus Lake representatives" and substituting "The 3 Cultus Lake representatives".

3 Section 6 (b) is repealed and the following substituted:

(b) The 3 Cultus Lake representatives shall be elected to the Board by persons who are leaseholders of the Board or who reside within Cultus Lake Park.

(c) Divisions 4 and 5 of Part 4 of the School Act, as they apply to a trustee election conducted by a board of school trustees, apply to the election of the Cultus Lake representatives except as otherwise provided and, for these purposes, the references in those Divisions are to be read in accordance with the following:

(i) a reference to a board is to be read as a reference to the Board;

(ii) a reference to a trustee electoral area is to be read as a reference to the Park;

(iii) a reference to the secretary treasurer of a board is to be read as a reference to the officer or employee of the Board assigned responsibility for these matters by the Board;

(iv) a reference to the minister is to be read as a reference to the minister responsible for this Act.

4 Sections 8, 9, 13, 15 (1) and 16 are amended by striking out "his" wherever it appears and substituting "his or her".

5 Sections 10, 11, 12, 15, 17 and 18 (2) (a) are amended by striking out "Chairman" wherever it appears and substituting "Chair".

6 Section 21 is amended by striking out "him" and substituting "him or her".

Transition — Cultus Lake Park Board

7  (1) In this section, "general local election" has the same meaning as in the Local Government Act.

(2) Sections 4, 5 (b) and 6 (b) and (c) of The Cultus Lake Park Act as they read on the date of First Reading of this Act continue to apply in relation to the following:

(a) the Board and members of the Board until successors to the members of the Board are elected in the 2014 general local election;

(b) elections of members of the Board and voting under Part 4 of the Local Government Act that are held before the 2014 general local election.

Commencement

8  This Act comes into force by regulation of the Lieutenant Governor in Council.
