PROPOSED AMENDMENTS ON NOTICE

Hon. S. Anton to move, in Committee of the Whole on Bill (No. 3) intituled Missing Persons Act to amend as follows:

SECTION 6 (2), by adding the text shown as underlined:

(2) A justice may make an order under this section if the justice is satisfied that there are reasonable grounds to believe that the record

(a) may assist the police force in locating the missing person, and

(b) is in the possession or under the control of the person.

SECTION 7 (3), by adding the text shown as underlined:

(3) A justice may make an order under this section if the justice is satisfied that

(a) the member made reasonable efforts to obtain the third party’s consent, if applicable,

(b) there are reasonable grounds to believe that the missing person

(i) may be in the company of the third party, or

(ii) was last seen in the company of the third party,

(c) there are reasonable grounds to believe that the record may assist the police force in locating the missing person, and

(d) there are reasonable grounds to believe that the record is in the possession or under the control of the person.

SECTION 11 (2), by adding the text shown as underlined:

(2) A justice may make an order under this section authorizing members of a police force to enter, by force if necessary, a private dwelling or other premises or land and search for a missing person if the justice is satisfied that there are reasonable grounds to believe that the missing person may be located there.

SECTION 16 (2), by adding the text shown as underlined:

(2) A justice may make an order under this section if the justice is satisfied that there are reasonable grounds to believe that the record specified in the demand

(a) may assist the police force in locating the missing person, and

(b) is in the possession or under the control of the person.

Hon. S. Thomson to move, in Committee of the Whole on Bill (No. 5) intituled Forests, Lands and Natural Resource Operations Statutes Amendment Act, 2014 to amend as follows:

SECTION 64, by deleting the text shown as struck out and adding the underlined text as shown:

64 Section 66.1 of the Wildfire Act, S.B.C. 2004, c. 31, is amended,

(b) by repealing subsections (3) and (4) and substituting the following:

(6) Subsection (3) does not apply to a legal proceeding against the government commenced on or before the date this subsection received First Reading in the Legislative Assembly February 13, 2014.

SECTION 86, by deleting the text shown as struck out and adding the underlined text as shown:

Wildfire Act Transition

86 (1) For certainty, section 66.1 (3) of the Wildfire Act, as enacted by this Act, must be applied and given effect in every legal proceeding commenced after the date section 64 of this Act received First Reading in the Legislative Assembly February 13, 2014.

(2) Section 66.1 (3) of the Wildfire Act, as enacted by this Act, must not be construed as lacking effect, whether retroactive or otherwise, in relation to any matter because it makes no specific reference to that matter.

(3) The repeal by this Act of section 66.1 (4) of the Wildfire Act does not affect a legal proceeding against the government commenced on or before the date section 64 of this Act received First Reading in the Legislative Assembly February 13, 2014.

SECTION 25, by deleting the text shown as struck out and adding the underlined text as shown:

Prohibitions on referrals

25 (1) A referring practitioner must not act contrary to a regulation made under section 71 (e)71 (f) [regulations respecting benefits, beneficiaries and referring practitioners] in referring a beneficiary to an approved laboratory facility for the purposes of receiving benefits.
