PROTECTED AREAS OF BRITISH COLUMBIA AMENDMENT ACT, 2015

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

SECTION 1: [Protected Areas of British Columbia Act, Schedule A]

1 Schedule A of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended by adding the following description:

MEGIN RIVER ECOLOGICAL RESERVE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Clayoquot District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 2012.

The whole ecological reserve containing approximately 54 hectares.

SECTION 2: [Protected Areas of British Columbia Act, Schedule B] removes the reference to Megin River Ecological Reserve that is added to Schedule A by this Bill.

2 Schedule B is amended by striking out "Megin River Ecological Reserve, established by Order in Council 1532/81".

SECTION 3: [Protected Areas of British Columbia Act, Schedule C]

3 Schedule C is amended

(a) in the description of Bodega Ridge Park

(i) by striking out "Plan 37 Tube 1899; except a 20 metre right of way centred on Ministry of Transportation's Porlier Pass Drive Road." and substituting "Plan 8 Tube 2011; except a 20 metre right of way centred on Porlier Pass Drive.", and

(ii) by striking out "233 hectares (195 hectares of upland and 38 hectares of foreshore)." and substituting "397 hectares (321 hectares of upland and 76 hectares of foreshore).",

(b) by repealing the name of Burges and James Gadsden Park and substituting the following:

BURGES JAMES GADSDEN PARK ,

(c) in the description of Burges James Gadsden Park by striking out "(368 hectares of upland and 36 hectares of foreshore)",

(d) by repealing the description of Carmanah Walbran Park and substituting the following:

CARMANAH WALBRAN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Renfrew District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 1921.

The whole park containing approximately 16 365 hectares. ,

(e) by repealing the name of Haynes Point Park and substituting the following:

SẀIẀS PARK [a.k.a. Haynes Point Park] ,

(f) in the description of Octopus Islands Marine Park

(i) by striking out "Plan 4 Tube 1953;" and substituting "Plan 11 Tube 2010;", and

(ii) by striking out "761 hectares (320 hectares of upland and 441 hectares of foreshore)." and substituting "862 hectares (404 hectares of upland and 458 hectares of foreshore).",

(g) by repealing the name of Okanagan Falls Park and substituting the following:

PARK [a.k.a. Okanagan Falls Park] ,

(h) by repealing the description of Omineca Park, and

(i) by repealing the descriptions of Small Inlet Marine Park, Strathcona Park and West Arm Park and substituting the following:

SMALL INLET MARINE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Sayward District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 2010.

The whole park containing approximately 878 hectares (753 hectares of upland and 125 hectares of foreshore).

STRATHCONA PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Clayoquot District, Comox District, Nelson District, Nootka District, Rupert District and Sayward District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 2003; except (1) Moyehai Indian Reserve 23; (2) Watta Indian Reserve 25; (3) Wappook Indian Reserve 26; (4) Highway 28; (5) Buttle Lake Bridge approaches as shown on Ministry of Transportation's Drawing 64-04-01 dated December 8, 1983; (6) a 30 metre right of way centred on the road within Gold River drainage as shown on plan titled "Elimination from Kyuquot Forest 920-3-12" dated October 16, 1980 on file with the Ministry of Forests, Lands and Natural Resource Operations; (7) Ash River Main Road; and (8) Statutory Right of Way Plan Over Part of Lot 1, Block 121, Comox District, Plan 13634, as shown on Plan VIP80052.

The whole park containing approximately 248 669 hectares (247 961 hectares of upland and 708 hectares of foreshore).

WEST ARM PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kootenay District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 1997; except (1) the Canadian Pacific Railway right of way and the Burlington & Northern Railway right of way along the West Arm of Kootenay Lake (as shown on various Plans); (2) Mineral Claim 234932; (3) Mineral Claim 234933; (4) Mineral Claim 234934; (5) Mineral Claim 234935; and (6) Mineral Claim 234936.

The whole park containing approximately 26 199 hectares.

SECTION 4: [Protected Areas of British Columbia Act, Schedule D]

4 Schedule D is amended

(a) in the description of Cariboo River Park by striking out "thence northwesterly on a bearing of 352° a distance of 800 metre;" and substituting "thence northwesterly on a bearing of 352° a distance of 800 metres;",

(b) in the description of Denman Island Park

(i) by striking out "Plan 12 Tube 1999;" and substituting "Plan 14 Tube 2009;", and

(ii) by striking out "552 hectares." and substituting "561 hectares.",

(c) in the description of E. C. Manning Park

(i) by striking out "Firstly: as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 1813; except Highway No. 3 as shown on Land Title Office Plans H150, H151, H157, H158, H215, H216, H217, H218, H219 and H17630, all on deposit in the Kamloops Land Title Office, Ministry of Transportation and Infrastructure's Project Drawings C1776 and C3914 and Highway Exchange Plan as shown on the Official Plan deposited in the Crown Land Registry as Plan 13 Tube 1944." and substituting "Firstly: as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 1813; except (1) Highway 3 as shown on Land Title Office Plans H150, H151, H157, H158, H215, H216, H217, H218, H219 and H17630, all on deposit in the Kamloops Land Title Office, on Ministry of Transportation and Highways' Project Drawings C1776 and C3914 and on Highway Exchange Plan as shown on the Official Plan deposited in the Crown Land Registry as Plan 13 Tube 1944; (2) Plan EPC1135 deposited in the Crown Land Registry; and (3) Plan EPC1153 deposited in the Crown Land Registry.", and

(ii) by striking out "The whole park containing approximately 83 670 hectares." and substituting the following:

Thirdly: District Lot 1938, District Lot 1939, District Lot 1940 and District Lot 1941 as shown on Plan EPC1255 deposited in the Crown Land Registry.

(d) by adding the following description:

OMINECA PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cassiar District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 1911; except (1) a 30 metre right of way centred on FSR 9147.01, Thutade; (2) a 30 metre right of way centred on the non-status road accessing the Nina Lake area; and (3) a 30 metre right of way centred on the existing road access to District Lot 1392.

The whole park containing approximately 132 296 hectares. , and

(e) by repealing the descriptions of Sulphur Passage Park, Wells Gray Park and White Ridge Park and substituting the following:

SULPHUR PASSAGE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Clayoquot District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2012.

The whole park containing approximately 2 232 hectares (1 235 hectares of upland and 997 hectares of foreshore).

WELLS GRAY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Kamloops Division, Yale District, Lillooet District and Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 2004; except (1) Clearwater Valley Road as shown on the Official Plans deposited in the Crown Land Registry as Plan 2 Tube 1562, Plan 4 Tube 1432, Plan 10 Tube 1529, Plan 11 Tube 1529, Plan 12 Tube 1529, Plan 12 Tube 1533, Plan 13 Tube 1533, Plan 16 Tube 1537 and Plan 17 Tube 1537, on Plan 40616, on deposit in the Kamloops Land Title Office, and on Road Survey No. 5709, on file with Ministry of Transportation and Infrastructure in Kamloops; (2) Helmcken Falls Road as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 1529; and (3) 1.845 hectares described as WGPP on Ministry of Transportation's (File #2021, Project 21924) Drawing R2-600-101-RW.

The whole park containing approximately 541 516 hectares.

WHITE RIDGE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Nootka District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2012.

The whole park containing approximately 1 386 hectares.

SECTION 5: [Rescission of order in council] rescinds the establishment by order in council of Megin River Ecological Reserve the description of which is added to Schedule A by this Bill.

Rescission of order in council

5  The establishment of Megin River Ecological Reserve by Order in Council 1532/81 is rescinded.

Protected Areas of British Columbia Amendment Act (No. 2), 2014

SECTION 6: [Protected Areas of British Columbia Amendment Act (No. 2), 2014, section 1] makes housekeeping amendments to a not-in-force amendment to the description of Anhluut'ukwsim Laxmihl Angwinga'asanskwhl Nisga'a [a.k.a. Nisga'a Memorial Lava Bed Park].

6 Section 1 of the Protected Areas of British Columbia Amendment Act (No. 2), 2014, S.B.C. 2014, c. 33, is amended

(a) by striking out "Ksi Sgasginist" and substituting "Ksi Sgasginist, and

(b) by striking out "159 46' 28"" and substituting "159° 46' 28"".

7  This Act comes into force on the date of Royal Assent.
