AN ACT TO ESTABLISH THE BOUNDARY BAY
WILDLIFE MANAGEMENT AREA

Preamble

WHEREAS Boundary Bay is a migratory bird habitat of international importance and is a key link on the migratory route from Alaska and Siberia through to Central and South America;

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Establishment of Boundary Bay Wildlife Management Area

1 (1) There is hereby established a wildlife management area as defined in the Wildlife Act, S.B.C. 1982, c. 57, to be known as the Boundary Bay Wildlife Management Area.

(2) The boundaries of the Boundary Bay Wildlife Management Area are set out in Schedule 1.

(3) Except as provided for in section 3, the boundaries of the Boundary Bay Wildlife Management Area shall not be changed except by an Act of the Legislature.

Aboriginal title not affected

2 Nothing in this Act shall be construed so as to prejudice any present or future claims of aboriginal title with respect to lands affected by this Act.

Clarification or identification of boundaries

3 Where the Minister of Environment considers it necessary to clarify or identify the boundary of the Boundary Bay Wildlife Management Area, the Lieutenant Governor in Council may, by regulation, amend all or part of Schedule 1, specifying the description of the boundary or boundaries that are being clarified or identified.

Commencement

4 This Act comes into force on the day on which assent is given.

 
SCHEDULE 1

[Section 1 (2)]

BOUNDARY BAY WILDLIFE MANAGEMENT AREA

All that area comprised of the tidal and sub-tidal lands of Boundary and Mud Bays, from the point where the west side of the bay crosses the 49th Parallel to the point where the east side of the bay crosses the 49th Parallel, together with sections of Crown land on the landward side of the dikes around the Bays and south of Highway 99 and other lands as may be designated by the Lieutenant Governor in Council.
