HUMAN RIGHTS AMENDMENT ACT, 1993

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 The definition of "discrimination" in section 1 of the Human Rights Act, S.B.C. 1984, c. 22, is amended by adding "2," after "section".

2 Section 2 is repealed and the following substituted:

Discriminatory publication

2 (1) No person shall publish, issue or display or cause to be published, issued or displayed any statement, publication, notice, sign, symbol, emblem or other representation that

(a) indicates discrimination or an intention to discriminate against a person or a group or class of persons, or

(b) is likely to expose a person or a group or class of persons to hatred or contempt

because of the race, colour, ancestry, place of origin, religion, marital status, family status, physical or mental disability, sex, sexual orientation or age of that person or that group or class of persons.

(2) Subsection (1) does not apply to a private communication or to a communication intended to be private.

 
Explanatory Notes

SECTION 1: adds public expressions of discrimination or hate messages to the definition of "discrimination" in the Human Rights Act.

SECTION 2: broadens the protection against publication, issue or display of discriminatory material and adds a prohibition against public expression of hate messages that are based on any of the specified grounds.
