18  The Hon. G. Clark to move, in Committee of the Whole on Bill (No. 18) intituled Motor Fuel Tax Amendment Act, 1993 to amend as follows:

SECTION 2.1, by adding the following section:

2.1 Section 11 (a) is amended by deleting "3˘" and substituting "4˘".

SECTION 11,

(a) in the proposed subsection (2) by adding "section 2 of" after "enacted by", and

(b) by adding the following subsections:

(4) Section 2.1 shall be deemed to have come into force on July 1, 1993 and is retroactive to the extent necessary to give it effect on and after that date.

(5) A regulation under section 14 of the British Columbia Transit Act to bring section 11 (a) of the Motor Fuel Tax Act as amended by section 2.1 of this Act into force in an area prescribed in the regulation may be made retroactive to July 1, 1993 and, if made retroactive,

(a) the regulation shall be deemed to have come into force on July 1, 1993, and

(b) section 11 (a) of the Motor Fuel Tax Act shall be deemed to have come into force in the prescribed area on July 1, 1993.

(6) Subsection (5) and this subsection are repealed on January 1, 1994.

21  Mr. Hanson to move, in Committee of the Whole on Bill (No. 21) intituled Consumer Protection Statutes Amendment Act, 1993 to amend as follows:

SECTION 15, is hereby amended by adding to section 1 of the Motor Dealer Act, R.S.B.C. 1979, c. 287, the following definition:

"claim" means a claim with respect to the lease, exchange, or other disposition or supply of a motor vehicle by a motor dealer to a customer, or any dealings involving a motor dealer and a customer in relation thereto.

32  The Hon. J. Cashore to move, in Committee of the Whole on Bill (No. 32) intituled Environmental Assessment Act to amend as follows:

SECTION 2, by deleting the proposed section 2 and substituting the following:

Purpose

2 The purposes of this Act are

(a) to protect the environment and foster a sound economy,

(b) to provide for the thorough, timely and integrated assessment of the environmental, economic, social, cultural and heritage effects of reviewable projects,

(c) to prevent or mitigate adverse effects of reviewable projects,

(d) to provide an open, accountable and neutrally administered process for the assessment

(i) of reviewable projects, and

(ii) of activities that pertain to the environment or to land use and that are referred to the board in accordance with the terms of reference mentioned in section 51 (c), and

(e) in an assessment under this Act, to provide for participation by the public, project proponents, first nations, municipalities and regional districts, the government and its agencies, the government of Canada and its agencies and British Columbia's neighbouring jurisdictions.

SECTION 9, by deleting the proposed paragraph (a) and substituting the following:

(a) the executive director may make available to the proponent the information, analysis and plans, and .

SECTION 11, by deleting the proposed section 11 and substituting the following:

Accommodating amendments to application

11 (1) As an alternative to submitting a new application under section 8, an applicant who intends to materially change the project or the manner of implementing it may submit a written request to the executive director to amend the original application as necessary to accommodate the intended changes.

(2) The request for amendments must set out the particulars of the intended amendments to the application and must be submitted before the issue or refusal of a project approval certificate under section 23, 39 or 43.

(3) The executive director must

(a) give notice to the public inviting written comments from the public describing any concerns about the intended amendments,

(b) file a copy of the notice and of the request for the amendments at the project registry, and

(c) specify a period of at least 15 but no more than 30 days during which written comments in response to an invitation under this section must be received at the office of the executive director in order to be taken into account in a decision under section 12.

SECTION 13,

(a) by adding "and" at the end of the proposed paragraph (c),

(b) by deleting the proposed paragraph (d), and

(c) in the proposed paragraph (e) ( i ) by deleting "the edited copy" and substituting "a copy".

SECTION 15, by deleting the proposed paragraphs (a) to (c) and substituting the following:

(a) file a copy of the comments at the project registry, and

(b) advise the applicant for the project approval certificate that the comments have been received and give the applicant an opportunity to respond to the written comments.

SECTION 16, by deleting the proposed section 16 and substituting the following:

Public information and consultation

16 (1) Before a decision may be made under section 23, an applicant, if and as directed to do so by the executive director, must carry out each or any combination of the following activities relating to the distribution of information about the project:

(a) advertise the application in the prescribed manner;

(b) conduct a program of public information and public consultation in the prescribed manner;

(c) provide to persons or organizations specified by the executive director a copy of the application, or notice of its availability for inspection at one or more locations specified by the executive director.

(2) In the absence of a direction under subsection (1) that the applicant carry out an activity listed in that subsection, that activity must be carried out by the executive director.

SECTION 20, in the proposed subsection (1) by deleting "written comments" and substituting "comments".

SECTION 23, in the proposed subsection (1) by deleting "written comments" wherever it appears and substituting "comments".

SECTION 26, in the proposed section 26 by deleting ", and" at the end of paragraph ( j ), by adding "and" at the end of paragraph (k) and by adding the following:

(l) detailed project design and operation specifications that are likely to be prerequisite to the applicant obtaining, under another enactment, an approval, licence, permit or other authorization that is pertinent to the project.

SECTION 30, by deleting the proposed paragraphs (a) to (c) and substituting the following:

(a) file a copy of the comments at the project registry, and

(b) advise the applicant for the project approval certificate that the comments have been received and give the applicant an opportunity to respond to the written comments.

SECTION 32, by deleting the proposed paragraph (a) and substituting the following:

(a) the executive director may make available to the proponent the information, analysis and plans, and .

SECTION 34,

(a) by deleting the proposed paragraph (d), and

(b) in the proposed paragraph (e) by deleting "the edited copy" and substituting "a copy".

SECTION 36, by deleting the proposed section 36 and substituting the following:

Public information and consultation

36 (1) Before a decision may be made under section 39, an applicant, if and as directed to do so by the executive director, must carry out each or any combination of the following activities relating to the distribution of information about the project:

SECTION 38, in the proposed subsection (1) (a) by deleting "written comments" and substituting "comments".

SECTION 39, in the proposed subsection (1) by deleting "written comments" wherever it appears and substituting "comments".

SECTION 48, by deleting the proposed subsection (1) and substituting the following:

(1) There is established the Environmental Assessment Board consisting of 3 regular members, each appointed under subsection (2) for a term of not less than 3 years, and the temporary members appointed under subsection (3).

SECTION 52, by adding the following subsection:

(1.1) The board may recommend to the minister and the responsible minister modifications to the terms of reference that the board considers appropriate to a review of the effects of the project that is the subject of the application.

SECTION 55, by deleting the proposed section 55 and substituting the following:

Costs of the board

55 In prescribed circumstances, the minister may order that the costs of the board incidental to a public hearing must be paid by one or more participants in the review, in amounts and proportions that the minister may determine.

SECTION 61, by deleting the proposed subsection (2) (c) (ii) and substituting the following:

(ii) under the Freedom of Information and Protection of Privacy Act, are available to the public.

SECTION 62, by deleting the proposed subsection (1) and substituting the following:

(1) In prescribed circumstances the minister, if the minister considers it to be necessary or desirable to enable or support the participation of one or more persons or organizations, in all stages of the review of an application for a project approval certificate, may

(a) pay all or part of the actual or anticipated costs of the participation by those persons or organizations in the review, and

(b) provide access to technical expertise.

SECTION 63, by deleting the proposed section.

SECTION 69, by deleting the proposed subsection (2) (d) and (e) and substituting the following:

(d) the holder of the certificate is in default of an order made under section 55 that the proponent pay costs of the board.

SECTION 84, in the proposed subsection (1) by deleting "reviewable project that is at least equivalent to the assessment that would otherwise be required under this Act." and substituting "reviewable project that, in the minister's opinion, is at least equivalent to the assessment that would otherwise be required under this Act."

SECTION 90, in the proposed subsection (2) by adding the following paragraph:

(f.1) prescribing the circumstances and defining "costs" for the purposes of section 55, .

35  The Hon. R. Blencoe to move, in Committee of the Whole on Bill (No. 35) intituled Local Elections Reform Act, 1993 to amend as follows:

SECTION 10,

(d) in the proposed section 91 (1) of the Municipal Act by adding ", or as a local trustee of the Islands Trust," after "board of school trustees",

(e) in the proposed section 97 (1) (a) of the Municipal Act by adding "electoral area" after "regional district",

(f) in the proposed section 100 (1) of the Municipal Act by deleting "by mail." and substituting "in conjunction with this voting.",

(g) in the proposed section 110 (2) of the Municipal Act by deleting paragraph (b) and substituting the following:

(b) persons assisting under section 49 or 121; ,

(h) in the proposed section 110 (4) of the Municipal Act by adding "at a voting place or special voting opportunity" after "must not be present",

(i) in the proposed section 113 (2) (d) of the Municipal Act by deleting "the ballot" and substituting "a ballot", and

(j) in the proposed section 163 (4) (a) of the Municipal Act by deleting "must be" and substituting "is".

SECTION 50,

(a) in the proposed section 42 (c) (i) of the School Act by deleting "under of Division (17)" and substituting "under Division (17)", and

(b) in the proposed section 63 of the School Act by adding the following subsection:

(2.1) As an exception to subsection (2), if fewer than 3 trustees remain in office, section 45 (5) applies to require that the vacant office be filled by election or appointment and section 147 (4) of the Municipal Act applies to the person elected or appointed to the vacant office and to the person declared disqualified.

SECTION 61,

(a) in the proposed section 23 (1) (a) of the Vancouver Charter by deleting "next", and

(b) in the proposed section 24 (1) (b) by deleting "next".

(c) in the proposed section 28 (2) of the Vancouver Charter by deleting "an election official." and substituting "a person authorized by the chief election officer or by the City Clerk.",

(d) in the proposed section 28 (3) of the Vancouver Charter by deleting "presiding election official," and substituting "person authorized to receive the application,",

(e) in the proposed section 47 (4) (d) of the Vancouver Charter by adding at the end of that paragraph "or is disqualified under section 64 from endorsing a candidate",

(f) in the proposed section 63 (1) of the Vancouver Charter by adding ", or as a local trustee of the Islands Trust," after "board of school trustees",

(g) in the proposed section 72 (1) of the Vancouver Charter by deleting "by mail." and substituting "in conjunction with this voting.",

(h) in the proposed section 82 (2) of the Vancouver Charter by deleting paragraph (b) and substituting the following:

(b) persons assisting under section 21 or 93; ,

(i) in the proposed section 82 (4) of the Vancouver Charter by adding "at a voting place or special voting opportunity" after "must not be present", and

(j) in the proposed section 85 (2) (d) of the Vancouver Charter by deleting "the ballot" and substituting "a ballot".

SECTION 62, in the proposed section 137 of the Vancouver Charter,

(a) by renumbering the section as section 137 (1) and by adding "under subsection (2)," after "Except as established", and

(b) by adding the following subsections:

(2) Subject to the limit that there must be at least 10 Councillors, the Council may, by by-law, change the number of Councillors, in which case the quorum for the Council is the lowest number of Council members that is a majority of the total Council size as established by the by-law.

(3) A by-law under subsection (2) must provide for an uninterrupted transition from the previous Council.

(4) A by-law under subsection (2) that would reduce the size of Council must not be adopted without the assent of the electors.

SECTION 67 (b), by deleting ' "the next annual election" ' and substituting ' "at the next annual election" '.

35  Mr. Fox to move, in Committee of the Whole on Bill (No. 35) intituled Local Elections Reform Act, 1993 to amend as follows:

SECTION 10, is hereby amended by adding to new section 86 of the Municipal Act, R.S.B.C. 1979, c. 290, the following subsection:

(3) A candidate or elector organization must not accept campaign contributions, either directly, or indirectly, for which federal or provincial tax credit receipts have been or are to be issued by virtue of eligible contributions to federal or to provincial political parties.

SECTION 10, is hereby amended by deleting from new section 97 of the Municipal Act, R.S.B.C. 1979, c. 290, all of subsection (2), and by substituting therefor the following:

(2) At least one advance voting opportunity must be held for an election by voting on the 10th day before general voting day.

SECTION 10, is hereby amended by adding to new section 154, subsection (2), of the Municipal Act, R.S.B.C. 1979, c. 290, the following paragraph:

(e) a candidate, elector organization, and any person acting on their behalf, who accepts, directly or indirectly, from a federal or provincial political party or one of its fund raising agents, a campaign contribution for which a tax credit receipt has been, or is to be issued, commits an offence, and is liable to a fine of not less than $2,000 and not more than $10,000.

SECTION 50, is hereby amended by deleting from new section 43, subsection (2), of the School Act, S.B.C. 1989, c. 61, the phrase "on the same board".

35  Mr. Cowie to move, in Committee of the Whole on Bill (No. 35) intituled Local Elections Reform Act, 1993 to amend as follows:

SECTION 10, in the proposed section 83 Section 83 be amended to read:

"provincial political party" means a political party as defined in the Election Act, S.B.C. 1979.

SECTION 10, in the proposed section 83 Section 83 be amended to read:

"registered federal political party" means a political party as defined in the Election Expenses Act (Canada).

SECTION 10, in the proposed section 87 Subsection 87 (3) be added to read:

No candidate or elector organization may receive contributions from either a registered federal political party, registered provincial political party, federal constituency organization or provincial constituency organization.

SECTION 10, in the proposed section 87 Subsection 87 (4) be added to read:

No registered federal candidate or registered provincial candidate may contribute to either a candidate or elector organization unless those contributions are personal funds of either the federal candidate or the provincial candidate.

SECTION 10, in the proposed section 100 Subsection 100 (2) be amended to read:

For a municipality, the only electors who may vote by mail ballot are property electors and persons who have a physical disability, illness or injury that affects their ability to vote at another voting opportunity.

SECTION 10, in the proposed section 100 Subsection 100 (3) (c) be added to read: persons who are property electors.

SECTION 50, in the proposed section 42 Subsection 42 (a) be amended to read:

a person who is disqualified under section 43 as an employee, or whose spouse is an employee of any school board, except as authorized under that section;

38  Mr. Serwa to move, in Committee of the Whole on Bill (No. 38) intituled Emergency Program Act to amend as follows:

SECTION 12, is hereby amended by adding the following subsection:

(1.1) The head of a local authority shall at all times use best efforts to obtain the prior agreement or consent to a declaration under subsection (1) of the other persons constituting the local authority, and shall, as soon as may be practicable, convene an emergency meeting of the local authority to assist in oversight and direction of the response to the emergency.

48  The Hon. C. Gabelmann to move, in Committee of the Whole on Bill (No. 48) intituled Representation Agreement Act to amend as follows:

SECTION 2,

(a) in the proposed paragraph (a) by deleting "people" and substituting "adults" and by adding "when" after "how,", and

(b) by deleting the proposed paragraph (b) and substituting the following:

(b) to avoid the need for the court to appoint someone to help adults make decisions, or someone to make decisions for adults, when they are incapable of making decisions independently.

SECTION 9,

(a) in the proposed subsection (1) (d) by deleting "section 34 (e)" and substituting "section 34 (f)", and

(b) in the proposed subsection (1) (g) by deleting "maintain" and substituting "manage".

SECTION 16,

(a) in the proposed subsection (2) (b) by deleting "and in the adult's best interests", and

(b) in the proposed subsection (3) by deleting "or in the adult's best interests".

SECTION 30,

(a) by deleting the proposed subsection (3) (d) and substituting the following:

(d) apply to the court for an order under the Adult Guardianship Act appointing a decision maker or guardian;

(d.1) apply to the court for an order confirming a change to, or the revocation of, a representation agreement, or for an order cancelling all or part of a representation agreement; , and

(b) in the proposed subsection (3) (e) by adding "or (d.1)" after "paragraph (d)".

SECTION 32, by deleting the proposed section 32 and substituting the following:

Court orders

32 (1) On application under section 30 (3) (d.1) or (e), the court may make an order confirming a change to, or the revocation of, a representation agreement or an order cancelling all or part of a representation agreement.

(2) When making an order under subsection (1), the court must consider, in the same order of priority as under section 16 (2) to (4), the wishes, instructions, values and beliefs of the adult who made the representation agreement.

(3) The court may not make an order that overrides the adult's wishes, instructions, values or beliefs unless

(a) the adult is incapable,

(b) the order is in the adult's best interests, and

(c) the court gives reasons for making the order.

SECTION 35,

(a) in the proposed subsection (4) by adding "written" before "approval", and

(b) by deleting the proposed subsection (5) and substituting the following:

(5) The Public Trustee is entitled

(a) to be heard if the litigation guardian applies to the court for approval of a settlement or compromise of a claim referred to in subsection (3), and

(b) to any costs the court orders.

SECTION 46, by deleting the proposed section 46 (b) and substituting the following:

(b) in subsection (2) by striking out "Subsection (1) does" and substituting "Subsections (1) and (1.1) do".

SECTION 54, by deleting the proposed section 54 and substituting the following:

54 Section 73 (1) and (4) is amended by adding "representative under the Representation Agreement Act," after "assignee,".

49  The Hon. C. Gabelmann to move, in Committee of the Whole on Bill (No. 49) intituled Adult Guardianship Act to amend as follows:

SECTION 1, in paragraph (b) of the proposed definition of "self-neglect" by deleting "or inadequately treated".

SECTION 8, in the proposed subsection (1) by deleting "and" at the end of paragraph (c), by adding ", and" at the end of paragraph (d) and by adding the following paragraph:

(e) any representation agreement made by the adult.

SECTION 18, by deleting the proposed paragraph (d) and substituting the following:

(d) without limiting paragraph (c), may authorize the guardian to

(i) physically restrain, move or manage the adult, or

(ii) have the adult physically restrained, moved or managed when it is necessary in the adult's best interests to do so and despite the adult's objections, .

SECTION 20,

(a) in the proposed paragraph (a) by deleting "section 34 (e)" and substituting "section 34 (f)", and

(b) by deleting the proposed paragraph (g) and substituting the following:

(g) to invest the adult's assets in investments that a trustee is not authorized to make under the Trustee Act, or .

SECTION 21, in the proposed section 21 by deleting everything after "but in that case" and substituting "section 19 (1) and (2) (a) of the Health Care (Consent) and Care Facility (Admission) Act applies."

SECTION 29,

(a) in the proposed subsection (1) (b) by deleting "and in the adult's best interests", and

(b) in the proposed subsection (2) by deleting "or in the adult's best interests".

SECTION 37, by deleting the proposed subsection (9) (c) and substituting the following:

(c) inform the parties who were served with the application that a copy of the report is available for inspection.

SECTION 41,

(a) in the proposed subsection (4), by adding "written" before "approval", and

(b) by deleting the proposed subsection (5) and substituting the following:

(5) The Public Trustee is entitled

(a) to be heard if the litigation guardian applies to the court for approval of a settlement or compromise of a claim referred to in subsection (3), and

(b) to any costs the court orders.

SECTION 44, by deleting "to stop the abuse or neglect" and substituting "to seek support and assistance".

49  Mr. Serwa to move, in Committee of the Whole on Bill (No. 49) intituled Adult Guardianship Act to amend as follows:

SECTION 20, is hereby amended by adding the following subsections:

(i) to alter in any way the adult's will.

(j) to move the adult's place of residence outside the Province of British Columbia.

SECTION 45, is hereby amended by adding to subsection (1) the following: "to which only section 46 in this Part applies."

SECTION 46, is hereby amended by adding to subsection (1) the following:

"and must report all such circumstances to a designated agency where the information indicates:

(c) physical or sexual assault, or,

(d) (i) deliberate psychological abuse or mistreatment, or

(ii) other mistreatment or neglect, reasonably likely to cause irreparable physical or psychological harm."

50  The Hon. C. Gabelmann to move, in Committee of the Whole on Bill (No. 50) intituled Public Guardian and Trustee Act to amend as follows:

SECTION 4,

(a) by deleting the proposed subsections (1) and (2) and substituting the following:

(1) To ensure the public interest is served, the Lieutenant Governor in Council must appoint an Advisory Board to provide advice and make recommendations to the Public Guardian and Trustee about the matters specified in subsection (3) and (4) and in section 27 (2), (5) and (6).

(2) The board is to consist of not less than 6 and not more than 12 members selected by the Lieutenant Governor in Council to reflect the cultural, geographic and diverse needs of the people served by the office of the Public Guardian and Trustee. , and

(b) in the proposed subsection (5) by deleting "sufficient information" and substituting "all information necessary".

SECTION 17, in the proposed subsection (1) by deleting "the assets of the young person or adult may be at risk." and substituting "that the interest in the trust, or the assets of the young person or adult, may be at risk, or that the attorney, representative or decision maker or guardian has failed to comply with his or her duties."

SECTION 18, in the proposed subsection (1) (d) by adding ", monitor" after "decision maker".

SECTION 19, in the proposed subsection (3) by adding "or a shorter period set by the Public Guardian and Trustee" after "7 days".

SECTION 27,

(a) by deleting the proposed subsection (1) and substituting the following:

(1) The Public Guardian and Trustee must arrange for

(a) periodic independent evaluations of the effectiveness of the Adult Guardianship Act, the Health Care (Consent) and Care Facility (Admission) Act, the Representation Agreement Act and this Act, and the regulations, policies and procedures enacted or developed under those Acts and this Act, and

(b) the preparation of interim and final reports on each evaluation. ,

(b) in the proposed subsection (3) by deleting "The" and substituting "An",

(c) in the proposed subsection (4) by deleting "The evaluation" and substituting "Each evaluation",

(d) in the proposed subsection (4) (c) by adding at the end "and other ways of achieving those objectives", and

(e) in the proposed subsections (5) and (6) by deleting "of the evaluation" and substituting "of an evaluation".

SECTION 28,

(a) by deleting the proposed paragraph (b), and

(b) in the proposed paragraph (g) by deleting everything after "complaints about" and substituting "services delivered to people and decisions made on their behalf by the Public Guardian and Trustee."

51  The Hon. E. Cull to move, in Committee of the Whole on Bill (No. 51) intituled Health Care (Consent) and Care Facility (Admission) Act to amend as follows:

SECTION 13, by deleting the proposed section 13 and substituting the following:

Exception -- informed consent not required for preliminary examination

13 A health care provider may undertake triage or another kind of preliminary examination, treatment or diagnosis of an adult without complying with section 6 if

(a) the adult indicates that he or she wants to be provided with health care, or

(b) in the absence of any indication by the adult, the adult's spouse, relative or friend indicates that he or she wants the adult to be provided with health care.

SECTION 14,

(a) in the proposed subsection (1) (d) by deleting "subsections (4) and (7)." and substituting "subsections (4) to (7).", and

(b) in the proposed subsections (2) (a) and (5) (a) by adding "or the decision about the adult's incapability" after "major health care".

SECTION 21, by deleting the proposed subsections (1) and (2) and substituting the following:

(1) If the adult rejects the facility care proposal, any one of the following who has reason to believe that the adult

(a) needs and would benefit from admission to the care facility mentioned in the facility care proposal, and

(b) is incapable of deciding to reject the proposal, may arrange for a designated agency to assess whether the adult is incapable of making that decision:

(c) a substitute decision maker, guardian or representative who is authorized to make decisions about the adult's personal care;

(d) the adult's spouse;

(e) a relative referred to in section 22 (2) (b) to (e);

(f) the adult's medical practitioner;

(g) the Public Trustee, if no one else is available.

SECTION 25, in the proposed subsection (1) by deleting "and" at the end of paragraph (b), by adding ", and" at the end of paragraph (c) and by adding the following paragraph:

54  Mr. Weisgerber to move, in Committee of the Whole on Bill (No. 54) intituled Constitution Amendment Act, 1993 to amend as follows:

SECTION 1, is hereby amended by deleting from new section 11, subsection (3), of the Constitution Act, R.S.B.C. 1979, c. 62, the phrase "may appoint a member of the Legislative Assembly to be the parliamentary secretary to a member of the Executive Council.", and by substituting therefor the following: "may appoint up to a total of six members of the Legislative Assembly to be parliamentary secretaries to members of the Executive Council."

SECTION 1, is hereby amended by adding to new section 15, subsection 6 (c) enter on behalf of the government of British Columbia into any agreement with any person or government of any country or part of a country.

SECTION 1, is hereby amended by deleting from new section 16, subsection (2), of the Constitution Act, R.S.B.C. 1979, c. 62, the phrase "by the Lieutenant Governor in Council or by Treasury Board." and by substituting therefor the following: "by enactment of the Legislative Assembly."

SECTION 9, is hereby amended by deleting from new section 2.1, paragraph (a), of the Environment Management Act, S.B.C. 1981, c. 14, the word "must" and by substituting therefor the word "may".

61  The Hon. E. Cull to move, in Committee of the Whole on Bill (No. 61) intituled Pharmacists, Pharmacy Operations and Drug Scheduling Act to amend as follows:

SECTION 1,

(a) in the proposed definition of "costs" by deleting "46, 49" and substituting "46, 47, 49",

(b) in the proposed definition of "practitioner" by deleting "health care profession established by regulation under any enactment of the Province" and substituting "prescribed health care profession",

(c) in the proposed definition of "prescription" by deleting "or supplementary practitioner", and

(d) by deleting the definition "regulations".

SECTION 7, in the proposed subsection (1) by deleting paragraph (c) and substituting the following paragraph:

SECTION 3, in the proposed section 2 by adding the following subsection:

(4) Each of the parties to a collective agreement shall, at the time that the collective agreement is filed with the minister under section 51 of the Labour Relations Code, notify the director if a provision in the collective agreement provides a lesser benefit to the employees covered by the collective agreement than the benefit provided by a section in a Part or regulation referred to in Column 2 of subsection (2).

Be it resolved that this House believe justice for all British Columbians is well served when the exact nature of aboriginal rights, including the inherent right to self-government, is defined through treaty making with provisions which protect the interests of non-aboriginal British Columbians and provide for the effective involvement of third parties.

Be it resolved that this Legislature endorse the concept of a "Triple-E" Senate: Equal, Effective, and Elected.

Be it resolved that this House support the Provincial Commission on Housing Options recommendation to legalize secondary suites, recognizing the urgent need to increase the supply of accessible and affordable rental housing for British Columbians; and urge British Columbia's municipalities to adopt measures which will eliminate the legal barriers to the rental of secondary suites.
 
9  Mr. Hartley to move--
Be it resolved that this House deplore the federal government's $1.6 billion cutback to cost-shared programs ($1,200 for each British Columbia household) and endorse a balanced approach to fiscal constraints that protects essential services of health, education and social services.
 
10  Mr. Mitchell to move--
Be it resolved that this Legislature, mindful of the growing public desire to see their elected representatives free to vote their consciences on issues before this Assembly, ask the Select Standing Committee on Parliamentary Reform, Ethical Conduct, Standing Orders and Private Bills, by way of a referral, to review those matters that should constitute a "question of confidence" for the government when voted upon in this Assembly.
 
11  Mr. Weisgerber to move--
Be it resolved that this Legislature honour the desire expressed by 83% of all voters' valid ballots in the 1991 general election to implement voter-sponsored initiatives by introducing and passing appropriate legislation during this session.

Be it resolved that the Government Services Ministry continue the work of the previous government in developing innovative and affordable methods of reusing, reducing and recycling products in government.

Be it resolved that this House urge the House of Commons to recognize and protect victims of violence by passing, in the current session of Parliament, the Private Member's Bill on "Threats, Intimidation and Stalking", introduced by the Member for New Westminster-Burnaby.

Be it resolved that this Legislature recognize the social and economic value of the Province's independent schools, and deplores any move to reduce support for these cost-effective educational facilities.

Be it resolved that this House is of the opinion that the Government of Canada has an obligation to consumers and taxpayers who fund Provincial Pharmacare programs to immediately introduce compensatory measures for the higher drug costs which will result from changes in federal law.

Be it resolved that this Legislature recommend that the adoption registry fee for service be waived in cases where the registry is unsuccessful in identifying the intended individual.

Be it resolved that this House regret the Government of Canada's management of the 1992 Aboriginal Fisheries Strategy and call upon the Federal Minister of Fisheries to take urgent remedial measures, including commitment of sufficient staff to prevent over-fishing and enforce rules firmly and impartially; timely consultation with the Province to enable British Columbia to carry out its responsibilities; and broadening the scope of the fishing license compensation program to compensate commercial fishers adversely affected.
 
18  Mr. De Jong to move--
Be it resolved that this Legislature urge the Government to work expeditiously toward establishing a university in the Fraser Valley.
 
19  Mr. Simpson to move--
Be it resolved that this House, mindful that society must care for, and listen to young peoples' concerns about the pressure they face, endorse the Hon. Attorney General's initiation of Canada's first Gang/Youth Contact Line, a part of government's response to gang and youth violence.
 
20  Mr. Hanson to move--
Be it resolved that this Legislature endorse the efforts of the Ministry of Transportation and Highways in developing programs to encourage young women in British Columbia to explore opportunities in civil engineering and technological careers through the FITT Program.
 
21  Mr. Giesbrecht to move--
Be it resolved that this House congratulate the CBC "Fifth Estate" production team for exposing the illegal fishing for Canadian salmon in the northern Pacific and calls upon the Government of Canada to restore its investigative efforts and work with the governments of Thailand, Taiwan and other countries to protect Canadian salmon from piracy.
 
22  Mr. Weisgerber to move--
Be it resolved that this Legislature honour the desire expressed by 81% of all voters' valid ballots in the 1991 general election to implement the voters' right to recall a member of the Legislative Assembly by introducing and passing appropriate legislation during this session.

Be it resolved that this House regret the decision of the Government of Canada to exempt all Goods and Services Tax information, rather than just personal or commercially sensitive data, from access to information rules.

Be it resolved that this Legislature condemn the continued imposition of a 14.48% import duty on exports of our softwood lumber to the U.S.
 
25  Mr. Mitchell to move--
Be it resolved that this Legislature condemn the British Columbia Ferry Corporation for failing to consult with communities affected by its experiment with all-night ferry sailings and encourages the said corporation not to proceed further with such experiments without engaging the support and approval of the communities involved.

Be it resolved that the government adopt hiring practices to hire on the basis of merit and ability, without any form of discrimination.

Be it resolved that the Standing Orders of the House be amended so that they prevent members with a tangible general pecuniary interest, or whose spouse or dependents have such an interest, from participating in the debate and votes on legislation.

Be it resolved that the House set an example for the Province by providing a work environment conducive to the requirements of parents of young children, which may include on-site daycare. Such a facility, its location and funding should be determined by an all-party committee.

1. To investigate whether the Executive Council of the province of British Columbia or any Member thereof, had knowledge of the decision to log Clayoquot Sound prior to the purchase of shares in MacMillan Bloedel by the B.C. Endowment Fund.
2. To investigate whether the Government's purchase of shares in MacMillan Bloedel affected the decision to log Clayoquot Sound.
3. To determine whether any Member of the Executive Council was in a position to influence the Government's decision to purchase shares in MacMillan Bloedel and the subsequent decision on logging Clayoquot Sound, and whether a conflict existed by any Member in such a position.
4. To ascertain whether a conflict exists following the decision by the Executive Council to purchase shares of MacMillan Bloedel knowing beforehand that the value of the shares would be affected by the decision subsequently made on Clayoquot Sound.
5. To determine whether any Member of the Executive Council, including the Minister of Finance, knowing the pending decision to log Clayoquot Sound, was in possession of information which could benefit shares held by the B.C. Endowment Fund, and to investigate whether such proprietary information benefitted or disadvantaged any individual or group holding shares in MacMillan Bloedel.
6. Determine (i) whether a recommendation to the B.C. Securities Commission respecting insider trading is warranted concerning the actions of Members of the Executive Council; (ii) whether trading laws apply equally to individuals, corporations and Governments who buy shares while in possession of such knowledge; and (iii) whether any practice of insider trading existed in the acquisition of MacMillan Bloedel shares which affect the value of such shares.
7. To determine the parameters and direction the Minister of Finance gives the B.C. Endowment Fund -- a line function of the Ministry of Finance -- on investment decisions, and whether any conflict exists in this relationship relating to the acquisition of MacMillan Bloedel shares.
8. To determine whether the B.C. Securities Commission possesses the arms length relationship to investigate insider trading charges levelled against another branch of the Ministry of Finance.
