Prayers by Mr. Dalton.

The House proceeded to "Orders of the Day."

Order for Committee of Supply called.

Pursuant to Sessional Order, order called for Section A of Committee of Supply to consider the estimates of the Minister of Forests.

Order called for resumption of debate on the amendment to the motion for second reading of Bill (No. 3) intituled Build BC Act.

Mr. Dalton rose on a point of order, namely, that the House is not empowered to resume the debate on second reading (the amendment) of Bill (No. 3) intituled Build BC Act, while Section A of the Committee of Supply was at the same time considering the estimates of the Minister of Forests.

Further submissions were made to the Chair on the point of order.

The Chair ruled that, upon the Government House Leader calling for estimates to be considered in Section A, and in the absence of an order for Committee of Supply in Section B being called, the remainder of the House remains intact and competent to consider such other business that may be properly put before it, in this instance debate on the amendment to the motion for second reading of Bill (No. 3).

The House resumed the adjourned debate on the amendment to the motion for second reading of Bill (No. 3) intituled Build BC Act.

The debate on the amendment continued.

On the motion of Ms. Tyabji, the debate on the amendment was adjourned to the next sitting of the House.

Two o'clock p.m.

On the motion of Mr. Weisgerber, Bill (No. M 215) intituled Fiscal Restraint Act was introduced, read a first time, and Ordered to be placed on the Orders of the Day for second reading at the next sitting after today.

On the motion of Mr. Chisholm, Bill (No. M 216) intituled Family Day Act was introduced, read a first time, and Ordered to be placed on the Orders of the Day for second reading at the next sitting after today.

The Hon. B. Barlee (Minister of Agriculture, Fisheries and Food) tabled the Annual Report of the Provincial Agricultural Land Commission, for the year ended March 31, 1992.

Order called for "Oral Questions by Members."

Mr. Mitchell rose on a point of order relating to management of Questions on Notice on the Order Paper.

The Hon. G. Clark made a submission.

The Speaker advised that it is up to the House to deal with management of the Order Paper.

The Speaker delivered her reserved opinion as follows:

Honourable Members:

Yesterday, at the afternoon sitting, the Honourable Member from Richmond East applied under Standing Order 35 to move adjournment of the House to discuss a definite matter of urgent and public importance.

The Honourable Member raised the matter of the Health Care Accord and the fact that the Health Labour Relations Association had rejected the Accord in a recent vote.

The Government House Leader submitted that the issue does not come within the scope of urgency as defined in the Standing Orders, and that the House would be moving immediately into the Ministry of Health estimates affording an early opportunity to discuss the matters raised by the Honourable Member for Richmond East.

Firstly, I wish to thank the Members for their submissions and to the Member for Richmond East for complying with Practice Recommendation #8 in giving the Speaker notice in writing before raising the matter in the House.

The pre-requisites for a motion under this Standing Order were outlined to this House in a decision given by the Chair yesterday at which time it was noted that an application under Standing Order 35 will fail when an ordinary parliamentary opportunity will occur shortly, or in time, to discuss the subject matter. As anticipated during submissions on this application, the Ministry of Health estimates were proceeded with during the same sitting in which the Standing Order 35 matter was raised, thereby providing an opportunity to discuss the matter in question.

Under these circumstances, the Honourable Member's application cannot succeed.

42. Resolved, That a sum not exceeding $63,837,419 be granted to Her Majesty to defray the expenses of Ministry of Forests, Fire Suppression, to 31st March 1994.

On the motion of the Hon. M. Sihota that the House recess for five minutes, a debate arose.

Section A of Committee of Supply having reported the last vote of the Estimates of the Ministry of Forests, debate on those Estimates was summarized, pursuant to Sessional Order of March 31, 1993.

The House resumed the adjourned debate on the motion for second reading of Bill (No. 3) intituled Build BC Act.

The debate continued.

Mr. K. Jones moved the following amendment--
That all the words after "that" be deleted, and "that" be followed by: "Bill 3, Build BC Act be not now read a second time, because:
1. All measures for which a separate spending authority is being created can be executed within all current ministry operations;
2. There has been no public consultation with the taxpayers of the Province as to their desire to set up a separate spending authority outside of legislative purview; and
3. This bill will increase the amount of debt held by the Province and will negatively impact on the ability of future generations to control their economic destiny."

The debate on the amendment continued.

On the motion of Mr. Gingell, debate on the amendment was adjourned to the next sitting of the House.

And then the House adjourned at 9.55 p.m.
