Order called for "Oral Questions by Members."

The Hon. A. Edwards (Minister of Energy, Mines and Petroleum Resources) tabled the Annual Report of the British Columbia Petroleum Corporation, 1992 - 1993.

By leave, Mr. K. Jones tabled a document entitled Information to Obtain a Search Warrant.

The Speaker delivered her reserved decision as follows:

Honourable Members:

On Tuesday last, the Honourable Member for West Vancouver-Garibaldi rose on a matter of privilege, relating to questions he had placed on the Order Paper and which had not, as yet, been answered.

Firstly, I wish to thank the Honourable Member for his courtesy in providing the Chair with notice in accordance with Practice Recommendation #7.

Secondly, the Chair wishes to comment briefly on the manner in which the matter of privilege was raised in the House. Our guidelines are stated at p. 36 of Parliamentary Practice in British Columbia and one of the essential elements required is "a brief written statement of the matter, which the Member reads to the House". This statement is intended to inform the House of the facts on which the matter is based, and in addition, any applicable authorities which may be of assistance to the Chair. In this instance, regrettably the Chair could not allow the completion of the statement in that several parts of the statement imported argument and conclusions. The Chair, however, has had the full text of the Honourable Member's statement and has considered all the relevant submissions therein.

In his statement, the Honourable Member makes the following submission: ". . . the Government's refusal to answer written questions on the notice paper impedes my ability as a Member of this Assembly from doing the job that my constituents sent me here for." As this appears to be the essence of the matter, I refer Honourable Members to the decision of a former Speaker of this House recorded in the Journals (J 1932) pp. 22 to 29, wherein it was ruled, and I quote, "a refusal to answer (a question) cannot be raised as a question of privilege, nor is it regular to comment upon such refusal".

While the Honourable Member may feel he has a grievance, the ruling to which I have referred clearly precludes the Chair from finding that a prima facie case of breach of privilege has been established.
