MLA PENSION ELIMINATION ACT

Preamble

WHEREAS it is considered beneficial to British Columbians to eliminate certain benefits payable to Members of the Legislative Assembly; and

WHEREAS it is the intention of this legislation to affect all those persons who are Members of the Legislative Assembly during the Thirty Fifth Parliament as well as all MLAs elected in the future to the Legislative Assembly:

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Title

1 This Act shall be cited as the MLA Pension Elimination Act.

Interpretation

2 Unless otherwise defined, all words used in this Act shall have the meaning ascribed to them in the Legislative Assembly Allowances and Pension Act, R.S.B.C. c. 228.

Elimination of MLA Pensions

3 Part 2 of the Legislative Assembly Allowances and Pension Act, R.S.B.C. c. 228, is hereby repealed, and such act is amended to be intituled the Legislative Assembly Allowances Act.

Allocation of Pension Accounts

4 Upon proclamation of this Act, the value of all MLA Pension Accounts as at October 16, 1991, as calculated pursuant to the regulations in force governing allowances granted under the Legislative Assembly Allowances and Pension Act, shall be transferred in the name of the MLA to an account maintained in the public service superannuation fund for the payment of pensions.

Refund of Contributions

5 Any contributions made by members who do not qualify for a pension shall be refunded, with interest, to the members or, on direction of the member, shall be paid into a registered retirement savings vehicle in the name of the member.

No Effect on Existing Pension

6 This Act shall not affect the rights of any member who qualified for a pension prior to October 16, 1991.

Proclamation and retroactive effect

7 This Act shall come into force upon proclamation, and shall be deemed to have been passed on October 16, 1991.

 
Explanatory Notes

This bill would eliminate all pension benefits granted to MLAs, effective the day before the last election.

If this Bill passed, MLAs first elected in the last election and MLAs recently qualifying for a pension would not be eligible for pension.

For those MLAs who qualified for a pension prior to October 16,1991, the value of the pension (as at October 16, 1991) would be transferred to the Superannuation Fund.

Retired MLAs who are already receiving their pension would not be affected by this legislation.
