EMPLOYMENT STANDARDS EXCLUSION ACT

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of British Columbia, enacts as follows:

Act excluded

1 Section 2 of the Employment Standards Act, S.B.C. 1993, c. 42 is repealed and replaced by the following:

2 (1) At the time of making, extending, or amending a collective agreement the parties may specifically exclude the operation of this Act and, if such exclusion is ratified by a majority vote of the employees subject to the collective agreement, this Act shall not apply to the collective agreement.

(2) A vote of employees for the purposes of section (1) shall be conducted pursuant to Part 3, Division 1 of the Labour Relations Regulation, B.C. Reg. 7/93.

Commencement

2 This Act shall come into force upon proclamation.

 
Explanatory Notes

This Bill will allow employers and trade unions to contract out of the Employment Standards Act through good faith collective bargaining where such contracting out is ratified by a majority of the affected employees. This Bill endorses the concept of good faith collective bargaining.
