FETAL ALCOHOL SYNDROME AWARENESS ACT

WHEREAS the Legislature recognizes the danger of Fetal Alcohol Syndrome and Fetal Alcohol effects; and,

WHEREAS both education and information have proven to be effective ways to reduce the incidence of Fetal Alcohol Syndrome; and,

WHEREAS the Legislature wishes to place suitable warnings on alcoholic products.

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definitions and Interpretation

1 In this Act:

"alcoholic product" means a product containing more than 3% alcohol by volume intended for human consumption.

"approved message" means a message defined by regulation.

Enactment

2 No alcoholic product may be sold or marketed within the Province of British Columbia unless it carries an approved message by way of label or otherwise of the danger of Fetal Alcohol Syndrome and the effects of inappropriate consumption of alcoholic products during pregnancy.

Regulations

3 The Lieutenant Governor in Council may make regulations including regulations

(a) Defining an approved message, and

(b) Specifying categories of packaging.

Commencement

4 This Act comes into force by regulation of the Lieutenant Governor in Council.
