ELECTORAL BOUNDARIES COMMISSION
AMENDMENT ACT, 1997

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1 Section 4 (1) of the Electoral Boundaries Commission Act, S.B.C. 1989, c. 65, is repealed and the following substituted:

(1) The commission member who is a retired judge appointed under section 2 (a) and the commission member who is appointed under section 2 (b) may be paid the remuneration for his or her services on the commission in an amount prescribed by the Lieutenant Governor in Council.

2 Section 5 (1) is repealed and the following substituted:

(1) The first commission shall be appointed during the second session of the 36th Parliament.

3 Section 4 (1) of the Electoral Boundaries Commission Act, R.S.B.C. 1996, c. 107, is repealed and the following substituted:

(1) The commission member who is a retired judge appointed under section 2 (1) (a) and the commission member who is appointed under section 2 (1) (b) may be paid remuneration for his or her services on the commission in an amount prescribed by the Lieutenant Governor in Council.

4 Section 5 is repealed and the following substituted:

Time of appointment of commission

5 (1) The first commission must be appointed during the second session of the 36th Parliament.

(2) A new commission must be appointed during the first session of the Legislature following every second general election following the appointment of the first commission.

 
Explanatory Notes

[Sections 3 and 4 of this bill amend the Revised Statutes of British Columbia, 1996. The Revised Statutes of British Columbia, 1996 come into force on April 21, 1997.]

SECTION 1: [Electoral Boundaries Commission Act, repeals and replaces section 4 (1)] amends section 4 to allow a retired judge appointed under section 2 (a) to be paid remuneration for his or her services on the commission.

SECTION 2: [Electoral Boundaries Commission Act, repeals and replaces section 5 (1)] amends section 5 to require the Legislature to appoint the first commission in the second session of the 36th Parliament.

SECTIONS 3 and 4: [Electoral Boundaries Commission Act, repeal and replace sectin 4 (1) and re-enact section 5] are consequential to the re-enactment of the statutes of British Columbia in the form of the Revised Statutes of British Columbia, 1996, which come into force on April 21, 1997. Sections 3 and 4 of the Bill make the same changes in the 1996 revision as sections 1 and 2 of the Bill make in the pre-revision version of the Electoral Boundaries Commission Act.
