FAMILY RELATIONS AMENDMENT ACT, 1998

1 Section 24 of the Family Relations Act, R.S.B.C. 1996, c. 128, is amended by adding the following subsection:

(1.1) The references to "other persons" in subsection (1) (c) and to "each person" in subsection (1) (e) include parents, grandparents, other relatives of the child and persons who are not relatives of the child.

2 Section 35 is amended by adding the following subsection:

(1.1) The reference to "persons" in subsection (1) includes parents, grandparents, other relatives of the child and persons who are not relatives of the child.

Commencement

3 This Act comes into force by regulation of the Lieutenant Governor in Council.

 
Explanatory Notes

SECTION 1: [Family Relations Act, adds section 24 (1.1)] provides express reference to parents, grandparents and other relatives of the child in the rule respecting a court's determination of the best interests of a child.

SECTION 2: [Family Relations Act, adds section 35 (1.1)] provides express reference to parents, grandparents and other relatives of the child in the court's power to make orders respecting custody and access to a child.
