PROPOSED AMENDMENTS ON NOTICE

19   The Hon. U. Dosanjh to move, in Committee of the Whole on Bill (No. 19) intituled Attorney General Statutes Amendment Act, 1998 to amend as follows:

SECTION 8, by deleting the proposed section 8 and substituting the following:

8 Section 61 (1) (a) is amended by striking out "sections 37, 46 and 47," and substituting "sections 17 (4), 37, 46 and 47,".

21   Mr. Gingell to move, in Committee of the Whole on Bill (No. 21) intituled Assessment Amendment Act, 1998 to amend as follows:

SECTION 12, to replace section 43 (1) within section 12 as follows:

Property assessment appeal board
43 (1) The Lieutenant Governor in Council must establish a property assessment appeal board and appoint at least 6 persons recommended by the Attorney General as members of the board.

SECTION 12, to replace section 43 (6) within section 12 as follows:

(6) (a) Persons appointed under subsection (1) shall be appointed to a term of 6 years or until age 70 whichever is sooner.
(b) The member designated chair under subsection (3) shall be paid an annual salary of 75% of the class 12 management position and the other members shall be paid 1/200 of 80% of the amount determined for the Property Assessment Appeal Board chair per diem.
(c) The appointment of a member found not fit to continue with their duties may be removed for cause by the Lieutenant Governor in Council.

SECTION 12, to replace section 49 contained within section 12 as follows:

Report
49 (1) In accordance with a regulation made under section 74 (2) (g) (iv), the board must annually and at other times it considers appropriate, report to the Attorney General on its activities under this Act and the regulations.

(2) The Attorney General must promptly lay the board's annual report before the Legislative Assembly if it is in session and, if the Legislative Assembly is not in session the report shall be submitted to the Speaker, where upon it will be deemed public.

SECTION 12, to replace section 57 (1) (a) within section 12 as follows:

Powers and duties of board in an appeal
57 (1) In an appeal under this Part, the board
(a) may reopen the whole question of the property's assessment to determine in a consistent manner in the municipality or rural area whether,
(i) there is an error or omission respecting the name of a person in the assessment roll;
(ii) there is an error or omission respecting land or improvements, or both land and improvements, in the assessment roll;
(iii) land or improvements, or both land and improvements, are not assessed at actual value;
(iv) land or improvements, or both land and improvements, have been improperly classified;
(v) an exemption has been improperly allowed or disallowed.

SECTION 12, to replace section 63 contained in section 12 as follows:

Amending the roll to reflect board decisions
63 (1) On receipt of notice of the board's decision under section 62, the assessor must
(a) subject to subsection (2) ensure that all amendments ordered to be made in the assessment roll by the board are made promptly, and
(b) ensure that a copy of the notice is available for public inspection during regular business hours.

(2) not withstanding 1 (a) the assessor shall not

(a) amend the assessment roll to reflect a decision of the board which increases the actual value, or change the classification adversely to the owner; or
(b) disallow an exemption
in the absence of an appeal of the assessment under section 50 by the assessor on that issue.

(3) If there is a conflict between the authenticated assessment roll and an amendment made under this section, the amendment prevails.

23   The Hon. C. McGregor to move, in Committee of the Whole on Bill (No. 23) intituled Park Amendment Act, 1998 to amend as follows:

SECTION 38.1, by adding the following section:

38.1 Schedule E is amended

(a) by repealing the description of Adams Lake Park and substituting the following:

1 ADAMS LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1784; except thereout the Crown land that is the subject of the Steep 3 Mineral Claim (Record #217738).

The whole containing approximately 102 hectares. ,

(b) by repealing the description of Bedard Aspen Park and substituting the following:

5 BEDARD ASPEN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 26 Tube 1779.

The whole containing approximately 182 hectares. ,

(c) by repealing the description of Deadman Hoodoos Park-Skookum Site and substituting the following:

20 DEADMAN HOODOOS PARK -- SKOOKUM SITE

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 21 Tube 1780.

The whole containing approximately 16 hectares. ,

(d) by repealing the description of Epsom Park and substituting the following:

27 EPSOM PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 27 Tube 1779; except thereout the Canadian National Railway right of way, as shown on Plan A462, on deposit in the Kamloops Land Title Office.

The whole containing approximately 74 hectares. ,

(e) by repealing the description of Lac Le Jeune Park and substituting the following:

39 LAC LE JEUNE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 28 Tube 1779; except thereout the road right of way, as shown on Ministry of Transportation and Highways Drawing Number 358-0-2 dated March 27, 1990.

The whole containing approximately 180 hectares. ,

(f) by repealing the description of Monte Creek Park and substituting the following:

45 MONTE CREEK PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 16 Tube 1789.

The whole containing approximately 3 hectares. ,

(g) by repealing the description of North Thompson Oxbows East Park and substituting the following:

50 NORTH THOMPSON OXBOWS EAST PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 1784; except thereout the Crown land that is the subject of Timber Licence Number T0713, Block 12, CP "F" and Timber Licence Number T0713, Block 12 B.

The whole containing approximately 288 hectares. ,

(h) by repealing the description of North Thompson Oxbows Manteau Park and substituting the following:

52 NORTH THOMPSON OXBOWS MANTEAU PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 1784; except thereout the Crown land that is the subject of Timber Licence Numbers T0713, Block 12 A.

The whole containing approximately 516 hectares. ,

(i) by repealing the description of Pritchard Park and substituting the following:

60 PRITCHARD PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 1787.

The whole containing approximately 43 hectares. ,

(j) by repealing the description of Roderick Haig-Brown Park and substituting the following:

65 RODERICK HAIG-BROWN PARK (HIUIHILL CREEK)

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 11 Tube 1778.

The whole containing approximately 88 hectares. , and

(k) by repealing the description of Wire Cache Park and substituting the following:

84 WIRE CACHE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in the Kamloops Division of Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 1789; except thereout Forest Service Road, Project 564-02.

The whole containing approximately 57 hectares.
