PROPOSED AMENDMENTS ON NOTICE

21   Mr. Gingell to move, in Committee of the Whole on Bill (No. 21) intituled Assessment Amendment Act, 1998 to amend as follows:

SECTION 12, to replace section 43 (1) contained in section 12 as follows:

Property assessment appeal board

43 (1) The Lieutenant Governor in Council must establish a property assessment appeal board and appoint at least 6 persons recommended by the Attorney General as members of the board.

SECTION 12, to replace section 43 (6) contained in section 12 as follows:

(6) (a) Persons appointed under subsection (1) shall be appointed to a term of 6 years or until age 70 whichever is sooner.

(b) The member designated chair under subsection (3) shall be paid an annual salary of 75% of the class 12 management position and the other members shall be paid 1/200 of 80% of the amount determined for the Property Assessment Appeal Board chair per diem.

(c) The appointment of a member found not fit to continue with their duties may be removed for cause by the Lieutenant Governor in Council.

SECTION 12, to replace section 49 contained in section 12 as follows:

Report

49 (1) In accordance with a regulation made under section 74 (2) (g) (iv), the board must annually and at other times it considers appropriate, report to the Attorney General on its activities under this Act and the regulations.

(2) The Attorney General must promptly lay the board's annual report before the Legislative Assembly if it is in session and, if the Legislative Assembly is not in session the report shall be submitted to the Speaker, where upon it will be deemed public.

SECTION 12, to replace section 57 (1) (a) contained in section 12 as follows:

Powers and duties of board in an appeal

57 (1) In an appeal under this Part, the board

(a) may reopen the whole question of the property's assessment to determine in a consistent manner in the municipality or rural area whether,

(i) there is an error or omission respecting the name of a person in the assessment roll;

(ii) there is an error or omission respecting land or improvements, or both land and improvements, in the assessment roll;

(iii) land or improvements, or both land and improvements, are not assessed at actual value;

(iv) land or improvements, or both land and improvements, have been improperly classified;

(v) an exemption has been improperly allowed or disallowed.

SECTION 12, to replace section 63 contained in section 12 as follows:

Amending the roll to reflect board decisions

63 (1) On receipt of notice of the board's decision under section 62, the assessor must

(a) subject to subsection (2) ensure that all amendments ordered to be made in the assessment roll by the board are made promptly, and

(b) ensure that a copy of the notice is available for public inspection during regular business hours.

(2) not withstanding 1 (a) the assessor shall not

(a) amend the assessment roll to reflect a decision of the board which increases the actual value, or change the classification adversely to the owner; or

(b) disallow an exemption

in the absence of an appeal of the assessment under section 50 by the assessor on that issue.

(3) If there is a conflict between the authenticated assessment roll and an amendment made under this section, the amendment prevails.

29   The Hon. P. Priddy to move, in Committee of the Whole on Bill (No. 29) intituled Tobacco Fee Act to amend as follows:

SECTION 5, by deleting the proposed subsection (1) (b) (i) and substituting the following:

(i) within 30 days after this section comes into force, to be considered for the 1998/99 fiscal year, and .

SECTION 13, by deleting "section 12" and substituting "section 12, a decision of the director under section 9 (1) to not approve a price for a tobacco product or a calculation by the director under section 10 (3) (a)".

29   Mr. Thorpe to move, in Committee of the Whole on Bill (No. 29) intituled Tobacco Fee Act to amend as follows:

SECTION 6, by adding the following subsection:

(5) Licence fees paid to the Crown pursuant to this Act shall be held in a trust fund and disbursed only for the purposes stated in paragraph 6 (1) in accordance with guidelines established by the Select Standing Committee on Health and Social Services.

31   The Hon. J. Kwan to move, in Committee of the Whole on Bill (No. 31) intituled Local Government Statutes Amendment Act, 1998 to amend as follows:

SECTION 289, in the proposed section 39 (1) of the Municipalities Enabling and Validating Act (No. 2), in paragraph (a) of the definition of "prescribed partnering agreement" by deleting "before the date" and substituting "before June 4, 1998, being the date".

SECTION 293, by deleting section 293.

SECTION 327, by deleting "before the date on which this Act is given First Reading" and substituting "before June 4, 1998, being the date on which this Act was given First Reading".

SECTION 328, by deleting "before the date on which this Act is given First Reading" and substituting "before June 4, 1998, being the date on which this Act was given First Reading".

SECTION 331, by deleting section 331 and substituting the following:

Commencement

331 (1) Section 53 (a) is deemed to have come into force on January 1, 1998 and is retroactive to the extent necessary to give it force and effect on and after that date.

(2) Sections 1, 3 to 52, 53 (b) and 54 to 329 come into force by regulation of the Lieutenant Governor in Council.

38   The Hon. U. Dosanjh to move, in Committee of the Whole on Bill (No. 38) intituled Pension Statutes Amendment Act (No. 2), 1998 to amend as follows:

SECTION 5.1, by adding the following section:

5.1 Section 15 (2) is amended by adding "or there is filed with the commissioner a written agreement or court order made under Part 5 or 6 of the Family Relations Act with the same effect" after "specified by the commissioner".

SECTION 8, by deleting the proposed section 20 (4.1).

SECTION 11, by deleting the proposed section 11 and substituting the following:

11 Section 17 (2) is amended by adding "or there is filed with the commissioner a written agreement or court order made under Part 5 or 6 of the Family Relations Act with the same effect" after "specified by the commissioner".

SECTION 14 (c), in the proposed section 22 (5.1) by deleting "subsection (5)" and substituting "subsection (2) (a) (ii)".

SECTION 23, by deleting the proposed section 23 and substituting the following:

23 Section 16 (3) is amended by adding "or there is filed with the commissioner a written agreement or court order made under Part 5 or 6 of the Family Relations Act with the same effect" after "specified by the commissioner".

SECTION 25 (b), in the proposed section 21 (3.1) by deleting "subsection (3)" and substituting "subsection (5) (a)".

38   Mr. Plant to move, in Committee of the Whole on Bill (No. 38) intituled Pension Statutes Amendment Act (No. 2), 1998 to amend as follows:

SECTION 1 (a), in reference to section 1 of the Legislative Assembly Allowance and Pension Act to add the words in boldface and to delete the words in strikeout as follows:

"spouse" means, in relation to another person,

(a) if there is no person to whom paragraph (b) or (c) applies, a person who at the relevant time was married to that other person, or

(b) a person who lived with that other person as husband and wife for the 2 year period immediately preceding the relevant time; or

(c) a person of the same gender who lived in a marriage-like relationship with that other person for the 2 year period immediately preceding the relevant time;, and

and to add the following definition:

"domestic partner" means, in relation to another person, if there is no person to whom "spouse" applies, a person who lived with that other person for the 2 year period immediately preceding the relevant time in a close, personal relationship that is of primary importance in both persons' lives and which has the attributes of permanence, sharing and interdependence; .

SECTION 1 (b), in reference to section 1 of the Legislative Assembly Allowance and Pension Act by deleting the amendment and substituting the following:

(b) by repealing the definition of "surviving spouse" and substituting the following:

"surviving spouse or domestic partner" means the surviving spouse of a member who was married to the member immediately before the member's death, or the surviving domestic partner of a member who was in a domestic partnership immediately before the member's death, as the case may be.

SECTION 2, in reference to section 22 (4) of the Legislative Assembly Allowance and Pension Act by amending the substitution to add "or domestic partner" after the word "spouse".

SECTION 3, in reference to section 31 (3) of the Legislative Assembly Allowance and Pension Act to delete the words "same gender spouse" and to substitute therefor "domestic partner".

SECTION 4, in reference to section 32 (2) (a) of the Legislative Assembly Allowance and Pension Act that the words "or domestic partner" be added after "spouse."

SECTION 5, in reference to section 1 (1) of the Pension (College) Act to add the words in boldface and to delete the words in strikeout as follows:

"spouse" means, in relation to another person,

(a) if there is no person to whom paragraph (b) or (c) applies, a person who at the relevant time was married to that other person, or

(b) a person who lived with that other person as husband and wife for the 2 year period immediately preceding the relevant time; or

(c) a person of the same gender who lived in a marriage-like relationship with that other person for the 2 year period immediately preceding the relevant time;, and

and to add the following definition:

SECTION 7 (a) and (b) in reference to Section 19 (2) of the Pension (College) Act by amending the substitution to add "or domestic partner" after the word "spouse".

SECTION 8 (a) in reference to Section 20 of the Pension (College) Act by adding the words in boldface:

(a) in subsection (3) by adding "or domestic partner, if permitted by the Income Tax Act (Canada)," after "the spouse", .

SECTION 8 (c) in reference to the Pension (College) Act to add the words "or domestic partner" after the word "spouse".

SECTION 9 in reference to Section 26 (5) of the Pension (College) Act to delete the words "same gender spouse" and to substitute therefor the words "domestic partner".

SECTION 10, in reference to Section 1 (1) of the Pension (Municipal) Act, RSBC 1996, c. 355 to add the words in boldface and to delete the words in strikeout as follows:

"spouse" means, in relation to another person,

(a) if there is no person to whom paragraph (b) or (c) applies, a person who at the relevant time was married to that other person, or

(b) a person who lived with that other person as husband and wife for the 2 year period immediately preceding the relevant time; or

(c) a person of the same gender who lived in a marriage-like relationship with that other person for the 2 year period immediately preceding the relevant time;, and

and to add the following definition:

"domestic partner" means in relation to another person, if there is no person to whom "spouse" applies, a person who lived with that other person for the 2 year period immediately preceding the relevant time in a close, personal relationship that is of primary importance in both persons' lives and which has the attributes of permanence, sharing and interdependence; .

SECTION 14 in reference to Section 22 of the Pension (Municipal) Act that the words "or domestic partnership" be added to the end of subsection (a).

SECTION 14 (b) in reference to Section 22 of the Pension (Municipal) Act that the words "or domestic partner" precede the proposed amendment to subsection (b) to read as follows:

(b) in subsection (3) by adding "or domestic partner, if permitted by the Income Tax Act (Canada)," after "the spouse",

SECTION 14 (c) in reference to Section 22 of the Pension (Municipal) Act that in the proposed new subsection 5.1 the words "or domestic partnership" follow the word "relationship."

SECTION 14 (e) in reference to the Pension (Municipal) Act be amended by amending the substitution to add the words "or domestic partner" after the word "spouse".

SECTION 15 in reference to Section 29 of the Pension (Municipal) Act be amended by deleting the words "same gender spouse" and substituting therefor "domestic partner".

SECTION 16, in reference to Section 1 (1) of the Pension (Public Service) Act, to add the words in boldface and to delete the words in strikeout as follows:

"spouse" means, in relation to another person,

(a) if there is no person to whom paragraph (b) or (c) applies, a person who at the relevant time was married to that other person, or

(b) a person who lived with that other person as husband and wife for the 2 year period immediately preceding the relevant time; , or

(c) a person of the same gender who lived in a marriage-like relationship with that other person for the 2 year period immediately preceding the relevant time;, and

and to add the following definition:

SECTION 19 (b), in reference to Section 26 (4) of the Pension (Public Service) Act, that the words "or domestic partner" follow the word "spouse".

SECTION 20 (a), in reference to Section 29 (3) of the Pension (Public Service) Act, by adding the words "or domestic partnership" after the words "marriage-like relationship".

SECTION 20 (b), in reference to Section 29 of the Pension (Public Service) Act, by adding the words "or domestic partner" after the word "spouse".

SECTION 20 (c), in reference to Section 29 (5) be amended by adding the words "or domestic partnership" after the word "relationship".

SECTION 21, in reference to Section 42 of the Pension (Public Service) Act by deleting the words "same gender spouse" and substituting therefor "domestic partner".

SECTION 22, in reference to Section 1 (1) of the Pension (Teachers) Act, to add the words in boldface and to delete the words in strikeout as follows:

"spouse" means, in relation to another person,

(a) if there is no person to whom paragraph (b) or (c) applies, a person who at the relevant time was married to that other person, or

(b) a person who lived with that other person as husband and wife for the 2 year period immediately preceding the relevant time; or

(c) a person of the same gender who lived in a marriage-like relationship with that other person for the 2 year period immediately preceding the relevant time;, and

and to add the following definition:

"domestic partner" means in relation to another person, if there is no person to whom "spouse" applies, a person who lived with that other person for the 2 year period immediately preceding the relevant time in a close, personal relationship that is of primary importance in both persons' lives and which has the attributes of permanence, sharing and interdependence; .

SECTION 25, in reference to section 21 (c) of the Pension (Teachers) Act, by amending the substitution to add the words in underline after the word "relationship" and deleting the word in strike out:

(c) in subsection (5) (a) by striking out "employee's last marriage" and substituting "employee's last marriage, or marriage-like relationship or domestic partnership, and .

SECTION 25 (b), in reference to section 21 of the Pension (Teachers) Act, be amended by adding the words "domestic partnership" after the word "relationship".

SECTION 26, in reference to section 27 of the Pension (Teachers) Act, by deleting the words "same gender spouse" and substituting therefor "domestic partner".

To add SECTION 4.1, to amend sections 17, 22, 26 and 30 of the Legislative Assembly Allowances and Pension Act, by striking out the word "spouse" wherever it appears and substituting "spouse or domestic partner."

To add SECTION 9.1, to amend sections 15, 18, 19 (2), 20 and 22 of the Pension (College) Act by striking out the word "spouse" wherever it appears and substituting the words "spouse or domestic partner."

To add SECTION 15.1, to amend sections 17, 21 (10), 22, 26 and 36 (d) of the Pension (Municipal) Act, by striking out the word "spouse" wherever it appears and substituting "spouse or domestic partner".

To add SECTION 15.2, to amend section 21 (10) (a) by striking out "married contributor" and substituting "married contributor or has a domestic partner".

To add SECTION 21.1, to amend sections 18 (4), 21 (3), 25, 26, 27, 29, 32, 35, 36 and 40 of the Pension (Public Service) Act by striking out the word "spouse" wherever it appears and substituting "spouse or domestic partner."

To add SECTION 21.2, to amend section 29 (3) by deleting the words "whether made before or after the contributor's marriage."

To add SECTION 21.3, to amend section 35 (2) (b) (i) by adding the words "or domestic partnership began" after the words "marriage to the employee occurred".

(b) a person who lived with that other person as husband and wife for the 2 year period immediately preceding the relevant time, or.

and insert the following:
