PROPOSED AMENDMENTS ON NOTICE

21  Mr. Plant to move, in Committee of the Whole on Bill (No. 21) intituled Definition of Spouse Amendment Act, 2000 to amend as follows:

SECTION 1, (Section 1 of the Adult Guardianship Act, R.S.B.C. 1996, c. 6,) by repealing the definition of "spouse" and substituting the following:

"spouse" means a person who is

(a) married to another person, and is not living separate and apart, within the meaning of the Divorce Act (Canada), from the other person, or

(b) living and cohabiting with another person in a marriage-like relationship.

and by adding the following definition:

"domestic partner" means a person who is living with another person in a close, personal relationship that is of primary importance in both person's lives and which has the attributes of permanence, sharing and interdependence.

24  Hon. A. Petter to move, in Committee of the Whole on Bill (No. 24) intituled Miscellaneous Statutes Amendment Act (No. 2), 2000 to amend as follows:

SECTION 16, by deleting the proposed section 68 (1) (a) of the Law and Equity Act and substituting the following:

(a) providing to parties to a court proceeding in the Supreme Court the ability to require the other parties to the proceeding to engage in mediation and setting out when and how that ability may be exercised,

(a.1) providing to parties to a court proceeding in the Provincial Court the ability to require the other parties to the proceeding to engage in mediation and setting out when and how that ability may be exercised or requiring those parties to engage in mediation,

(a.2) setting out the rights and duties that accrue to the parties to a court proceeding, the court and the mediator if mediation is required in relation to that court proceeding, and

25  Hon. G. Mann Brewin to move, in Committee of the Whole on Bill (No. 25) intituled Secure Care Act to amend as follows:

SECTION 8,

(a) in the proposed subsection (1) by deleting "for a specified period of not more than 30 days" and substituting "for a period specified under subsection (1.1) of this section", and

(b) by adding the following subsection:

(1.1) The period specified by the board in a secure care certificate must be no longer than, in the board's opinion, is necessary for the purpose of assessing and assisting the child, but in any event must not exceed 30 days.

SECTION 9 (4), by adding the following paragraph:

(a.1) change the period of detainment specified under section 8 (1.1); .

SECTION 20 (5), by adding the following paragraph:

(a.1) change the period of detainment specified under section 8 (1.1); .
