HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

Definition

1 In this Act, "timber sale licence" means an agreement in the form of a timber sale licence under the Forest Act.

Timber sale licences cancelled

2 Each of the following timber sale licences is cancelled:

(a) Timber Sale Licence A54889, under which Sladey Timber Ltd. is the licensee;

(b) Timber Sale Licence A56175, under which Gurney Creek Trading Inc. is the licensee.

Direct award

3 Despite section 11 of the Forest Act, the Minister of Forests, without advertising or accepting applications, may enter into a timber sale licence

(a) with Sladey Timber Ltd., as a replacement for Timber Sale Licence A54889, and

(b) with Gurney Creek Trading Inc., as a replacement for Timber Sale Licence A56175.

Criteria for award

4 A timber sale licence entered into under section 3 must

(a) be of substantially the same value as the timber sale licence cancelled under section 2 that it replaces, and

(b) describe one or more areas of land other than within the area that is the subject of the draft Sliammon Agreement-in-Principle dated February 24, 2001 and initialed by the parties to it.

 
Explanatory Note

This Bills cancels 2 timber sale licences and provides for their replacement by timber sale licences of substantially the same value. The cancellation and replacement is for the purpose of accommodating the draft Sliammon Agreement-in-Principle dated February 24, 2001 among the Sliammon First Nation, Canada and British Columbia.
