CONSUMER PROTECTION IN TICKET SALES ACT, 2009

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

This Bill amends the Business Practices and Consumer Protection Act to provide for consumer protection in ticket sales.

1. The Business Practices and Consumer Protection Act, S.B.C. 2004, c. 2 is amended by adding the following sections:

Part 4.2 — Consumer Protection in Ticket Sales

Price to be clearly printed on ticket

56.6  An event promoter or event organizer is responsible for ensuring that tickets for admission, or other evidence of the right of entry to an event are clearly printed with the price of admission.

No sale of tickets above ticket price

56.7  Except as may be provided by the regulations under section 56.9 [regulations respecting ticket sales], a supplier may not sell or offer to sell any ticket for admission, or any other evidence of the right of entry, to an event for a price in excess of the price printed on the ticket.

No diversion of tickets by event promoters

56.8  An event promoter or event organizer may not divert tickets to a supplier for sale or resale at a price in excess of the price printed on the ticket.

Regulations respecting ticket sales

56.9  The Lieutenant Governor in Council may make regulations as follows:

(a) extending or limiting the meaning of "event";

(b) providing for the collection of a reasonable service charge from a consumer in return for services actually rendered;

(c) establishing circumstances when section 56.7 [no sale of tickets above ticket price] does not apply.
