PROTECTED AREAS OF BRITISH COLUMBIA AMENDMENT ACT, 2013

HER MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

SECTION 1: [Protected Areas of British Columbia Act, Schedule A] increases the size of Mount Maxwell Ecological Reserve.

1 Schedule A of the Protected Areas of British Columbia Act, S.B.C. 2000, c. 17, is amended in the description of Mount Maxwell Ecological Reserve

(a) by striking out "Plan 4 Tube 1911." and substituting "Plan 11 Tube 1999.", and

(b) by striking out "390 hectares." and substituting "418 hectares."

SECTION 2: [Protected Areas of British Columbia Act, Schedule C]

2 Schedule C is amended

(a) in the description of Boyle Point Park

(i) by striking out "Plan 2 Tube 1907; except B.C. Hydro Power Line right of way as shown on Plan 3 Tube 973 deposited in the Crown Land Registry." and substituting "Plan 13 Tube 1999; except British Columbia Hydro and Power Authority right of way Plan 2083RW, as also shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 973.", and

(ii) by striking out "128 hectares." and substituting "188 hectares.",

(b) in the description of Bridge Lake Park

(i) by striking out "Plan 3 Tube 1907." and substituting "Plan 11 Tube 1992; except 20 metre rights of way centred on the non-status access roads.", and

(ii) by striking out "25 hectares (12 hectares of upland and 13 hectares of foreshore)." and substituting "405 hectares.",

(c) by adding the following description:

GERALD ISLAND PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Nanoose District and contained within the following described boundaries:

District Lot 55-G.

The whole park containing approximately 12 hectares. ,

(d) by repealing the description of Inkaneep Park and substituting the following:

INKANEEP PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Similkameen Division, Yale District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 2002.

The whole park containing approximately 16 hectares. ,

(e) by repealing the description of Truman Dagnus Locheed Park, and

(f) in the description of Wakes Cove Park by striking out everything in the first paragraph after "deposited in the Crown Land Registry as" and substituting "Plan 14 Tube 1999."

SECTION 3: [Protected Areas of British Columbia Act, Schedule C] re-enacts the description of Elk Falls Park to replace a metes and bounds description with an official plan description and decrease the size of the park.

3 Schedule C is amended by repealing the description of Elk Falls Park and substituting the following:

ELK FALLS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Sayward District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 15 Tube 1996; except (1) that part of Highway 28 described in Order in Council 414/99; (2) the transmission line right of way as shown on Plan 1908RW; (3) the powerhouse access road right of way as shown on Plan 557RW; and (4) the proposed Elk Falls Protected Area as shown on Plan 15 Tube 1997 on file at BC Parks, Victoria.

The whole park containing approximately 1 065 hectares.

SECTION 4: [Protected Areas of British Columbia Act, Schedule D]

4 Schedule D is amended

(a) by adding the following descriptions:

BEAVER VALLEY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 1992.

The whole park containing approximately 767 hectares.

BECHER'S PRAIRIE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 1992.

The whole park containing approximately 125 hectares.

BIG BASIN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1992.

The whole park containing approximately 998 hectares.

COPPER JOHNNY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 1998.

The whole park containing approximately 656 hectares.

CRATER LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 1998; except those portions of Mineral Claim 532209 lying outside the boundary of the mineral reserve established under B.C. Reg. 23/2000 as Crater Lake - 100 Mile House Goal 2 PPA and by reference to site number 372053.

The whole park containing approximately 95 hectares.

DANTE’S INFERNO PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 13 Tube 1992.

The whole park containing approximately 376 hectares.

DONNELY LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 15 Tube 1992.

The whole park containing approximately 814 hectares.

DRAGON MOUNTAIN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 1993; except (1) Plan 28301 as shown on the Official Plan deposited in the Crown Land Registry as Plan 23 Tube 1132; (2) communication statutory right of way Plan 17426; (3) hydro statutory right of way Plan CG1050; (4) a 20 metre right of way centred on Durrell Road; and (5) Commercial Licence 515837 described as that parcel or tract of land located in the vicinity of Dale Lake Cariboo District containing 0.279 hectares, more or less, on Land Act file 5404474 at the Ministry of Forests, Lands and Natural Resource Operations, Quesnel.

The whole park containing approximately 1 773 hectares.

ELEVEN SISTERS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 13 Tube 1993; except those portions of Mineral Claim 511965, Mineral Claim 606674, Mineral Claim 606684, Mineral Claim 606686, Mineral Claim 606712, Mineral Claim 606714, Mineral Claim 606716, Mineral Claim 615863, Mineral Claim 840951 and Mineral Claim 840953 lying outside the boundary of the mineral reserve established under B.C. Reg. 163/96 as Scum Lake - Cariboo/Chilcotin and by reference to site number 344759.

The whole park containing approximately 3 052 hectares.

FRASER RIVER BREAKS PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 1993; except a 20 metre right of way centred on the non-status road, Chilcotin-Meldrum Road.

The whole park containing approximately 883 hectares.

LONG CREEK PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 2 Tube 2006; except those portions of Mineral Claim 514285, Mineral Claim 514289, Mineral Claim 602883 and Mineral Claim 650343 lying outside the boundary of the mineral reserve established under B.C. Reg. 163/96 as Long Creek Caribou Mineral Lick-Cariboo/Chilcotin and by reference to site number 344749.

The whole park containing approximately 254 hectares.

PATTERSON LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 2, Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 3 Tube 2006; except a 20 metre right of way centred on the non-status road.

The whole park containing approximately 1 595 hectares.

PUNTI ISLAND PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 4 Tube 2006.

The whole park containing approximately 12 hectares.

QUESNEL LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2006; except (1) those portions of Mineral Claim 518216 lying outside the boundary of the mineral reserve established under B.C. Reg. 296/2005 as Quesnel Lake - Faux Bay and by reference to site number 1000407; (2) those portions of Mineral Claim 409496, Mineral Claim 409497 and Mineral Claim 525437 lying outside the boundary of the mineral reserve established under B.C. Reg. 296/2005 as Quesnel Lake - Horsefly Bay and by reference to site number 1000408; and (3) those portions of Placer Claim 616043 lying outside the boundary of the mineral reserve established under B.C. Reg. 296/2005 as Quesnel Lake - Faux Bay and by reference to site number 1000407.

The whole park containing approximately 872 hectares.

RAINBOW/Q’IWENTEM PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 14 Tube 1992; except a 20 metre right of way centred on Deka Lake Road ending at the boundary of District Lot 8175.

The whole park containing approximately 385 hectares.

REDBRUSH PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Range 3 Coast District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2006.

The whole park containing approximately 1 165 hectares.

TITETOWN PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cariboo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 7 Tube 2006.

The whole park containing approximately 1 070 hectares. ,

(b) by repealing the descriptions of Flat Lake Park, Marble Range Park, Moose Valley Park and Schoolhouse Lake Park and substituting the following:

FLAT LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 8 Tube 1998.

The whole park containing approximately 4 275 hectares.

MARBLE RANGE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 10 Tube 1998; except (1) Mineral Claim 208888; (2) Mineral Claim 208889; (3) Mineral Claim 310968; (4) Mineral Claim 310969; (5) Mineral Claim 310970; (6) Mineral Claim 310971; (7) Mineral Claim 321062; (8) Mineral Claim 321063; (9) Mineral Claim 321067; and (10) those portions of Mineral Claim 208932, Mineral Claim 208933 and Mineral Claim 321064 lying outside the boundary of the mineral reserve established under B.C. Reg. 374/2006 as Marble Range - Inholdings and by reference to site number 1001622.

The whole park containing approximately 19 236 hectares.

MOOSE VALLEY PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 9 Tube 1998.

The whole park containing approximately 2 500 hectares.

SCHOOLHOUSE LAKE PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Lillooet District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 1 Tube 1999; except (1) those portions of Mineral Claim 508185 lying outside the boundary of the mineral reserve established under B.C. Reg. 23/2000 as Eagle Creek West - 100 Mile House Goal 2 PPA and by reference to site number 372055; and (2) those portions of Mineral Claim 505254, Mineral Claim 507667, Mineral Claim 508185, Mineral Claim 517575, Mineral Claim 554089 and Mineral Claim 560651 lying inside the boundary of the mineral reserve established under B.C. Reg. 280/2007 as Schoolhouse Lake Park Addition and by reference to site number 1005403.

The whole park containing approximately 5 106 hectares. ,

(c) in the description of Mara Meadows Park

(i) by striking out "Plan 10 Tube 1882." and substituting "Plan 10 Tube 1882; except Woodlot Licence W1572." , and

(ii) by striking out "219 hectares." and substituting "212 hectares.", and

(d) in the description of Upper Violet Creek Park

(i) by striking out everything in the first paragraph after "Plan 2 Tube 1877;" and substituting "except (1) a 30 metre right of way for FSR 4609-01, Larch Hills, 3.5 metres from the road centreline on the creek side of the road to 26.5 metres from the road centreline on the uphill side of the road based on the road centreline; (2) a 30 metre right of way centred on FSR 4609-02, Larch Hills-East Canoe; (3) a 30 metre right of way centred on FSR 4609-04, Larch Hills-Rosemond; and (4) Woodlot Licence W1572.", and

(ii) by striking out "124 hectares." and substituting "123 hectares."

SECTION 5: [Protected Areas of British Columbia Act, Schedule D] establishes Denman Island Park.

5 Schedule D is amended by adding the following description:

DENMAN ISLAND PARK

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Denman Island, Nanaimo District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 12 Tube 1999; except (1) Plan VIP87752; (2) a 20 metre right of way centred on Pickles Road; (3) a 20 metre right of way centred on Central Road; and (4) a 20 metre right of way centred on Lake Road.

The whole park containing approximately 552 hectares.

SECTION 6: [Protected Areas of British Columbia Act, Schedule E] establishes Hanna-Tintina Conservancy.

6 Schedule E is amended by adding the following description:

HANNA–TINTINA CONSERVANCY

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cassiar District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 6 Tube 2011; except (1) the Highway 37 right of way as shown on the Official Plans deposited in the Crown Land Registry as Plan 12 Tube 1742, Plan 15 Tube 1985 and Plan 5 Tube 1081, and that portion of Highway 37 located south and east of the portion shown on that Plan 15 Tube 1985; (2) a 30 metre right of way centred on FSR R03781, Tintina Main; (3) a 30 metre right of way centred on FSR R03781, Pine Flats; (4) a 30 metre right of way centred on FSR 10255, Meziadin; (5) all roads that access the Legal Subdivision as shown on Land Title Office Plan PRP7577 and Plan BCP 5432; (6) the former disposal site accessed through DL 2450A assigned 'B' as shown on the sketch dated October 2012 on file at BC Parks, Victoria; and (7) those portions of Mineral Claim 880129, Mineral Claim 880209, Mineral Claim 880309, Mineral Claim 889550 and Mineral Claim 889551 lying outside the boundary of the mineral reserve established under B.C. Reg. 61/2009 as Hanna-Tintina Watershed and by reference to site number 1003602.

The whole conservancy containing approximately 23 702 hectares.

SECTION 7: [Protected Areas of British Columbia Act, Schedule E] establishes Ne’ah’ Conservancy.

7 Schedule E is amended by adding the following description:

NE’ĀH’ CONSERVANCY

All those parcels or tracts of Crown land, together with all that foreshore or land covered by water, situated in Cassiar District and contained within the described boundaries as shown on the Official Plan deposited in the Crown Land Registry as Plan 5 Tube 2011; except (1) Horse Ranch Pass Indian Reserve 4, DL 5466; and (2) Mosquito Creek Indian Reserve 5, DL 5469.

The whole conservancy containing approximately 233 304 hectares.

8  The provisions of this Act referred to in column 1 of the following table come into force as set out in column 2 of the table:
