Special Committee to Review the Freedom of Information and Protection of Privacy Act

​​The all-party Special Committee to Review the Freedom of Information and Protection of Privacy Act (RSBC 1996, chapter 165) was appointed on May 27, 2015 to undertake a comprehensive review of the Act. Adopted in 1992, the Act provides British Columbians with a statutory right of access to records in the custody or control of public bodies, subject to certain exceptions, governs how public bodies collect, use, and disclose personal information, and requires public bodies to protect the personal information that they have in their custody or control. The statute requires that a special committee of the Legislative Assembly review the provisions of the Act every six years.

Terms of Reference

​On May 27, 2015, the Legislative Assembly agreed that a Special Committee be appointed to review the Freedom of Information and Protection of Privacy Act (RSBC 1996 c. 165) pursuant to section 80 of that Act, and that the Special Committee so appointed shall have the powers of a Select Standing Committee and is also empowered:

  1. to appoint of their number one or more subcommittees and to refer to such subcommittees any of the matters referred to the Committee;
  2. to sit during a period in which the House is adjourned, during the recess after prorogation until the next following Session and during any sitting of the House;
  3. to adjourn from place to place as may be convenient;
  4. to conduct public consultations by any means the Committee considers appropriate, including but not limited to public meetings and electronic means; and
  5. to retain personnel as required to assist the Committee;

and shall submit a report, including any recommendations respecting the results of the review, to the Legislative Assembly within one year of this resolution being adopted by the House; and shall deposit the original of its reports with the Clerk of the Legislative Assembly during a period of adjournment and upon resumption of the sittings of the House, the Chair shall present all reports to the Legislative Assembly.
