Special Committee to Review the Personal Information Protection Act

Welcome

​On December 9, 2020, the Legislative Assembly agreed that a Special Committee be appointed to review the Personal Information Protection Act [SBC 2003, c. 63] in accordance with section 59 of that Act.

The Act governs how private sector organizations can collect, use, and disclose personal information. It also requires organizations to protect and secure personal information against unauthorized use or disclosure, and grants individuals the right to access their own personal information. Section 59 of the Act requires a Special Committee to review the Act every six years.

According to the Committee's Terms of Reference, any information that was provided to the Committee in 2020 is referred to the current Committee. Presentations or written submissions provided to the previous Committee will inform the current Committee's consultation, deliberations and recommendations.

The Committee's consultation will focus on the provisions in Bill C-11 and the European Union's General Data Protection Regulation (GDPR), as well as on the Office of the Information and Privacy Commissioner for British Columbia's recommendations to the Committee. Those who did not have an opportunity to present during the 2020 public hearings are invited to make a presentation to the Committee; those who made a presentation or written submission in 2020 are invited to provide updated written information. Registration for the public hearings will open the week of May 17, 2021. Once confirmed, information regarding opportunities to participate in the consultation will be updated.

Terms of Reference

On December 9, 2020, the Legislative Assembly agreed that a Special Committee be appointed to review the Personal Information Protection Act (S.B.C. 2003, c. 73) pursuant to section 59 of that Act and that the Special Committee shall have the powers of a Select Standing Committee and, in addition, be empowered to:

  1. appoint of its number one or more subcommittees and to refer to such subcommittees any of the matters referred to the Special Committee and to delegate to the subcommittees all or any of its powers except the power to report directly to the House;

  2. sit during a period in which the House is adjourned, during the recess after prorogation until the next following Session and during any sitting of the House;

  3. conduct consultations by any means the Special Committee considers appropriate;

  4. adjourn from place to place as may be convenient; and

  5. retain personnel as required to assist the Special Committee.

That any information or evidence previously under consideration by the Special Committee appointed by order of the House on February 18, 2020 be referred to the Special Committee.

That the Special Committee shall submit a report, including any recommendations respecting the results of the review, to the Legislative Assembly within one year of this motion being adopted by the House; and shall deposit the original of its reports with the Clerk of the Legislative Assembly during a period of adjournment, and upon resumption of the sittings of the House, the Chair shall present all reports to the Legislative Assembly.
